Interim Measures for the Administration of Tibet Autonomous Region's Acceptance of Overseas NGO and Individual Grant Assistance Projects

- Article 1 In order to strengthen the management of overseas non-governmental organizations, individual grants, and aid projects, regulate grant assistance and beneficiaries, in accordance with the relevant laws and regulations of the country and the autonomous region, and in accordance with the actual conditions of our region, formulate these measures.
- Article 2 The foreign NGOs and individuals (hereinafter referred to as donors) grants and assistance (hereinafter referred to as assistance ) referred to in these Measures refer to overseas NGOs and individuals who volunteer for the education, science, technology, culture, health, Provision of funds, materials and technology for public welfare undertakings such as sports, environmental protection, poverty alleviation, and social welfare, as well as public facilities, industrial and agricultural production.
- The recipients and recipients (hereinafter referred to as recipients) referred to in these Measures refer to the enterprises, social groups, and other social organizations that accept grants and assistance, and accept the recipients of grants, assistance, and project cooperation.
- Article 3 For aid aid projects, the aid aid shall fully consult the aided unit and the aided unit to jointly determine the aid method, amount and recipients. To provide assistance, the aid unit shall provide the aided unit, the person in charge and personal information, detailed address, source of funds, etc.
- After receiving the grant and assistance, the aided unit shall issue a valid and valid receipt to the aided person and register the aided property.
- Article 4 Aid projects that violate national, autonomous region laws, regulations, and rules may harm national security and the social stability of our region. Additional conditions and the autonomous region consider it unacceptable shall not be accepted.
- In the selection of the location of the aided project and the determination of the aided areas, the aided unit shall adhere to the principle to ensure the correct implementation of the aided project.
- Article 5 The foreign affairs offices of the people's governments at all levels are responsible for the guidance, supervision and management of overseas non-governmental organizations and personal assistance projects.
- The competent department of the aided unit shall be responsible for the coordination and supervision of the use and management of the aided project.
- Article 6 Before accepting assistance, the aid person shall submit a letter of intent to the aided unit. The assistance received by the prefecture (city) unit shall be reported to the district administration or the municipal people's government for review. The aided units of the autonomous region accept assistance, and the aided units shall report to the competent department of the autonomous region for review. After being reviewed by the competent department of the aid unit or the prefecture (city), it is reported to the Foreign Affairs Office of the People's Government of the Autonomous Region for review, and the Foreign Affairs Office reports to the Autonomous Region People's Government for approval.
- To declare and approve an aid project, you must complete the "Approval Form for Approval of Aid Projects" printed by the Foreign Affairs Office of the autonomous region.
- If enterprises, social groups and other social organizations accept donations on a temporary basis, the enterprises, social groups and other social organizations shall present valid vouchers to the donors and complete the relevant examination and approval procedures.
- Article 7 The foreign affairs office and the competent department of the people's government of the autonomous region shall submit their review and examination opinions within 10 working days from the date of receiving the notification from the aided unit, and report to the people's government of the autonomous region. Except in special cases.
- Article 8 The aided unit shall set up accounts for the aided projects. At the end of the year, the competent authorities of the prefecture (city) and the aided unit shall consolidate and submit the report to the Foreign Affairs Office of the Autonomous Region Government for record.
- The Foreign Affairs Office of the Autonomous Region shall do a good job of archiving and keeping the materials of the aided projects, and report the status of the aided projects to the People's Government of the Autonomous Region at the end of the year.
- Article 9 The imported materials for assistance shall be examined and approved by the Foreign Affairs Office of the autonomous region. Assistance that belongs to the implementation of import license management (including tariff quotas, specific bidding for mechanical and electrical products) and quota management materials shall be reported to the People s Government of the Autonomous Region or relevant state departments for examination and approval in accordance with national regulations.
- Article 10 The aided units shall be used in accordance with the letter of intent or agreement, and no unit or individual may misappropriate.
- Article 11 The use of assistance projects shall fulfill the obligations stipulated in the letter of intent for assistance or agreement, ensure the realization of the purpose of the assistance, and provide feedback to the donors on the use of their assistance projects.
- Article 12 Construction projects to be assisted in construction must comply with urban and rural construction planning and national economic and social development plans, and emphasize social, economic, and environmental benefits. The required planned land must be reviewed by the autonomous region's foreign-related construction project review office and processed in accordance with relevant state regulations. - Article 13 For aided construction projects, the aided units shall carry out construction in accordance with the infrastructure procedures and relevant regulations of the construction administrative department. After the project is completed, it must be accepted by the local construction engineering quality supervision department before it can be delivered for use. After being put into use, the aided unit shall strengthen management and give full play to its benefits.
- Article 14 In the case of vetting and approving non-governmental organizations and individual grants and assistance projects in violation of the provisions of these Measures, the Foreign Affairs Office of the People's Government of the Autonomous Region shall submit their opinions to the People's Government of the Autonomous Region. The people's government of the autonomous region shall order the relevant units to make corrections and impose administrative sanctions on those responsible; if a crime is constituted, it shall be transferred to the judicial organ for criminal responsibility according to law.
- Article 15 The interpretation of these measures shall be the responsibility of the Foreign Affairs Office of the autonomous region in conjunction with relevant departments.
