Chapter I General Provisions
Article 1 In order to strengthen the control of the professional access of urban planning professionals, guarantee the quality of urban planning work, and safeguard the interests of the country, society, and the public, according to the "People's Republic of China Urban Planning Law" and relevant regulations of the professional qualification system, This provision.
Article 2 The term "registered urban planners" as used in these Provisions refers to professional and technical personnel who have passed the unified national examination, obtained the qualification certificate of registered urban planners, and are engaged in urban planning work after registration.
Article 3 The qualification system for registered urban planners belongs to the scope of the professional qualification certificate system, and is included in the unified planning of the qualification system for professional and technical personnel, which is confirmed and approved by the state.
Article 4 All urban planning departments and units shall be equipped with registered urban planners in key positions such as the corresponding urban planning preparation and approval, urban planning implementation management, research and formulation of urban planning policies and regulations, urban planning technical consultation, and comprehensive urban development planning. The specific measures shall be separately stipulated by the Ministry of Construction.
Article 5 The Ministry of Personnel and the Ministry of Construction are jointly responsible for the policy formulation, organization and coordination, qualification examination, registration and supervision of the national urban planners' qualification system.
Chapter II Examination
Article 6 The national qualification examination for registered urban planners shall adopt a unified national outline, unified propositions, and unified organization. It is held once a year in principle.
Article 7 Citizens of the People's Republic of China, who abide by the law and meet one of the following conditions, may apply to take the registered city planner qualification examination:
(1) Obtained a college degree in urban planning and has been engaged in urban planning business for 6 years.
(2) Obtain a bachelor's degree in urban planning major and have been engaged in urban planning business for 4 years; or obtain a bachelor's degree in a similar urban planning major and have been engaged in urban planning business for 5 years.
(3) Acquired an undergraduate degree in urban planning major that has passed the assessment and has been engaged in urban planning business for 3 years.
(4) Having obtained a master's degree in urban planning, and engaged in urban planning business for 3 years.
(5) A master's degree in urban planning or a similar professional doctorate degree, and engaged in urban planning business for at least two years.
(6) Having obtained a doctorate degree in urban planning and engaged in urban planning business for at least one year.
(7) Other conditions stipulated by the Ministry of Personnel and the Ministry of Construction.
Article 8 The Ministry of Construction is responsible for organizing relevant experts to compile examination outlines, compile training materials and organize propositions, and uniformly plan and organize pre-exam training and other related tasks.
Pre-exam training must be conducted in accordance with the principle of separate training and examinations and voluntary participation.
Article 9 The Ministry of Personnel is responsible for organizing relevant experts to review examination subjects, examination outlines, and test questions, and to inspect, supervise and guide examinations in conjunction with the Ministry of Construction. Article 10 Those who pass the examination of registered urban planners' qualifications shall be issued by the personnel departments of the provinces, autonomous regions, and municipalities directly under the Central People's Republic of China, and printed by the Ministry of Personnel and Ministry of Construction.
Chapter III Registration
Article 11 The Ministry of Construction and the administrative departments of planning of provinces, autonomous regions and municipalities are responsible for the registration management of registered urban planners.
Personnel departments at all levels are responsible for checking and supervising the registration of registered urban planners.
Article 12 Persons who apply for registration after obtaining the qualification certificate of registered urban planner may apply in person and submit to the local provincial urban planning administrative department for review after the consent of the unit where they are located, and shall report to the Ministry of Construction for registration.
Approved applicants will be issued a "Certificate of Registered Urban Planner" by the Ministry of Construction
Article 13 Persons applying for registration must also meet the following requirements:
(1) Abide by disciplines and laws, and abide by the professional ethics of registered urban planners;
(2) Obtaining the practicing qualification certificate of a registered urban planner;
(3) Appraisal and consent of the unit to which it belongs;
(4) Good health and ability to work in a registered urban planner position.
Those who re-register shall pass the assessment of the unit and have proof of participation in continuing education and business training.
Article 14 Each registration of a registered urban planner is valid for three years. Three months before the expiration of the validity period, the certificate holder shall re-register.
Article 15 If a registered urban planner has any of the following circumstances, the unit in which it is registered shall report to the provincial urban planning administrative department in a timely manner, and the relevant provincial urban planning administrative department must promptly complete the registration cancellation procedure with the Ministry of Construction:
(1) completely lost the capacity for civil conduct;
(2) Being subject to criminal punishment;
(3) leaving the post of registered urban planner for more than 2 consecutive years;
(4) Those who suffered losses due to mistakes in urban planning work, received administrative penalties or were dismissed from administrative sanctions.
If the party whose registration has been cancelled has objections to the cancellation of registration, it may apply to the Ministry of Construction for reconsideration within 15 days after receiving the notice of cancellation of registration.
Chapter IV Rights and Obligations
Article 16 Registered urban planners shall strictly implement national laws, regulations and technical specifications on urban planning work, act impartially, safeguard the interests of the public and ensure the quality of work results.
Article 17 A registered urban planner has the right to sign and seal the drawings and texts of the results of urban planning work as well as the construction land and construction project planning approval documents, and bears the corresponding legal and economic responsibilities.
Article 18 A registered urban planner has the right to advise on violations of relevant national laws, regulations, and technical requirements and decisions, and may report to the higher-level urban planning department while refusing to implement it.
Article 19 Registered urban planners shall keep technical and economic secrets at work.
Article 20 A registered urban planner may not be employed by two or more units to carry out urban planning business at the same time. Do not allow others to perform business in their own name.
Article 21: Registered urban planners receive continuing education for professional and technical personnel in accordance with regulations, continuously update their knowledge, and improve their work standards. Participate in the required professional training and assessment as one of the prerequisites for re-registration.
Chapter V Supplementary Provisions
Article 22 For professional and technical personnel who have obtained the qualification of registered urban planners through examinations in accordance with these regulations, the unit may employ corresponding intermediate professional and technical positions according to the needs of the work.
Article 23 The administrative measures for overseas personnel to apply for the examination for the qualification of registered urban planners and to apply for urban planning work in China shall be separately formulated after approval by the relevant departments of the State Council.
Article 24 The Ministry of Personnel and the Ministry of Construction shall be responsible for the interpretation of these regulations according to the division of responsibilities. These regulations come into effect on the date of promulgation
