Nursery school kindergarten health care management measures
The "Administrative Measures for the Nursery School Kindergarten Health Care" was reviewed and approved by the Ministerial Meeting of the Ministry of Health on March 1, 2010, and has been implemented since November 1, 2010 with the approval of the Ministry of Education.
Article 1 These measures are formulated to improve the level of health care work in nurseries and kindergartens, prevent and reduce the occurrence of diseases, and protect the physical and mental health of children.
Article 2 These measures are applicable to all types of nurseries and kindergartens (hereinafter referred to as childcare institutions) for children 0 to 6 years old.
Article 3 Child care institutions shall implement the policy of combining education with education and giving priority to prevention, and do a good job of health care.
Article 4 The health administrative departments of the people's governments at or above the county level shall take the health care work of childcare institutions as an important part of public health services, and strengthen supervision and guidance.
The education administrative departments of the people's governments at and above the county level assist the health administrative departments in inspecting and guiding the health care work of child care institutions.
Article 5 Maternal and child health institutions above the county level are responsible for providing operational guidance to the health care work of child care institutions within their jurisdictions. The contents of business guidance include: diet nutrition, physical exercise, health check, sanitation and disinfection, and disease prevention.
Disease prevention and control institutions shall provide disease prevention and control consulting services and guidance to childcare institutions on a regular basis.
The health supervision and law enforcement agency shall supervise and inspect the drinking water hygiene, infectious disease prevention and control of childcare institutions according to law.
Article 6 Where a child care institution has a canteen to provide catering services, it shall seriously implement various food safety requirements in accordance with the requirements of the Food Safety Law, the Implementation Regulations of the Food Safety Law, and relevant regulations.
Food and drug supervision and management departments and other departments in charge of catering service supervision and management shall strengthen the guidance, supervision and inspection of food safety in child care institutions according to law.
Article 7 The buildings, facilities, equipment, environment, food and drinking water provided by childcare institutions shall meet the requirements of relevant national health standards and regulations.
Article 8 A newly established childcare institution shall obtain a health evaluation report issued by a medical and health institution designated by the health administrative department of the local people's government at or above the county level in compliance with the "Career Nursery Kindergarten Health Care Work Standards".
The administrative departments of education at all levels shall incorporate the quality of health care work into the hierarchical management of childcare institutions.
Article 9 The legal representative or person in charge of the childcare institution is the first person responsible for the health care work of the institution.
Article 10 Childcare institutions shall set up corresponding health rooms or health rooms according to the scale and the number of children received, etc., and shall be specifically responsible for health care.
Clinics should meet the basic standards of medical institutions and obtain the Medical Institution Practice Permit issued by the administrative department of health.
The health room shall not carry out diagnosis and treatment activities, and its configuration shall meet the basic requirements for setting up a health room.
Article 11 Child-care institutions shall employ health-care personnel who comply with state regulations. Health care personnel include physicians, nurses, and health workers.
Physicians working in the clinic shall obtain the "Practice Certificate of Physician" issued by the administrative department of health, and nurses shall obtain the "Certificate of Nurse Practice".
Health workers working in the health room should have a high school education or above, be trained in health care professional knowledge, have basic health care knowledge in a child care institution, and have skills in sanitation, infectious disease management, and nutrition and diet management.
Article 12 The employment of health care personnel in child care institutions shall be based on the proportion of 150 children entrusted with at least one full-time health care personnel. For children under 150, full-time or part-time health care personnel shall be provided.
Article 13 Health care personnel in child care institutions shall receive regular training in health care professional knowledge organized by local maternal and child health institutions.
The health care personnel of the child care institution shall provide specific guidance to the staff in the institution on health knowledge publicity and education, disease prevention, sanitation and disinfection, diet nutrition, food hygiene, and drinking water hygiene.
Article 14 Before taking up a job, the staff of a childcare institution must undergo a medical examination at a medical and health institution designated by the health administrative department of the people's government at or above the county level, and they can only get employed after obtaining the "Health Qualification Certificate for Staff of Childcare Institutions".
Childcare institutions shall organize on-the-job staff to conduct a health check once a year; if the on-the-job staff suffers from infectious diseases, they shall immediately leave their posts for treatment, and may not work until they are cured.
People with mental illness and history of mental illness are not allowed to work in child care institutions.
Article 15 Child-care institutions shall carry out health-care work in strict accordance with the "Code for the Health Care Work of Nurseries and Kindergartens."
The health care work of childcare institutions includes the following:
(1) Establish a scientific and reasonable one-day living system according to the characteristics of children's different ages, and cultivate children's good health habits;
(2) Provide children with a reasonable nutritional diet, formulate recipes scientifically, and ensure a balanced diet;
(3) Develop a physical exercise plan that is compatible with the physical characteristics of children, carry out games and sports activities according to the age characteristics of children, and ensure that children's outdoor activities time, and improve children's physical and mental health;
(4) Establish a health examination system, carry out regular health examinations of children, and establish health records. Insist on morning inspection and full-day health observation, prevent common diseases, and deal with problems in a timely manner;
(5) Strictly implement the sanitation and disinfection system, and do a good job of indoor and outdoor environment and personal hygiene. Strengthen food hygiene management to ensure food safety;
(6) To assist in the implementation of the national immunization plan. Children should be checked for their vaccination certificates when they enter the nursery. Children who have not been vaccinated as required should inform their guardians and urge the guardians to bring the children to the local vaccination unit for replanting;
(7) Strengthen daily nursing care and carry out project management for frail children. Cooperate with maternal and child health institutions to regularly carry out child eye, ear, and oral health, and carry out mental health care for children;
(8) Establish a sanitation safety management system, implement various sanitation safety protection work, and prevent injury accidents;
(9) Formulate health education plans and carry out various forms of health education activities for children and their parents;
(10) Do a good job of collecting, summarizing and reporting on various health care work information.
Article 16 Childcare institutions shall do a good job in the prevention and control of infectious diseases under the guidance of disease prevention and control institutions.
When a child care institution finds a child with infectious diseases, it shall report in a timely manner in accordance with laws, regulations and the provisions of the Ministry of Health, and strictly disinfect the environment under the guidance of the disease prevention and control agency.
During the epidemic of infectious diseases, childcare institutions should strengthen prevention and control measures.
Article 17: Disease prevention and control agencies shall collect, analyze, investigate and verify the epidemic situation of infectious diseases in childcare institutions, report any problems to the childcare institutions in a timely manner, and report to the administrative departments of health and education.
Article 18 Before entering a childcare institution, a child shall undergo a medical examination by a medical and health institution, and may enter a childcare institution only after passing the examination.
When a child care institution finds that a child in the park (suspension) has a suspected infectious disease, it shall promptly notify its guardian to leave the clinic (treatment) for treatment. After the children with infectious diseases are cured, they can only enter the school with the health certificate issued by the medical and health institution.
Children who have left the nursery for more than 3 months should undergo a medical examination before they can enter the nursery again.
Medical and health institutions shall carry out health examinations in accordance with the prescribed medical examination items, and shall not make unauthorized changes in violation of the provisions.
Article 19 Under any of the following circumstances, the child care institution shall be ordered by the administrative department of health to make corrections within a time limit and notified of criticism; if it is not overdue, a warning shall be given; if the circumstances are serious, administrative penalties shall be imposed by the administrative department of education according to law:
(1) failing to establish a health room, health room or equipped with health care personnel as required;
(2) employing staff who have not undergone a medical examination or failed medical examinations;
(3) failing to regularly organize staff health checks;
(4) Recruiting children who have not undergone a medical examination or failed medical examinations into a child care institution;
(5) Failure to carry out the health care work in strict accordance with the "Health Care Work Standards for Nursery Schools".
The administrative department of health shall inform the administrative department of education in a timely manner, and the administrative department of education shall use it as the basis for the classification and management and quality evaluation of childcare institutions.
Article 20: Childcare institutions that have not obtained the Medical Institution Practice Permit to establish clinics for diagnosis and treatment without authorization shall be punished in accordance with the relevant provisions of the Management Regulations for Medical Institutions.
Article 21 If a childcare institution fails to perform its health care duties in accordance with regulations, causing public health emergencies such as infectious disease epidemics and food poisoning, the administrative departments of health and education shall punish them in accordance with relevant laws and regulations.
If the medical and health institutions at or above the county level fail to perform their duties in accordance with these Measures, leading to public health emergencies in child care institutions, the health administrative department shall punish them in accordance with relevant laws and regulations.
Article 22 Pre-schools attached to primary schools and pre-schools separately established shall be implemented with reference to these Measures.
Article 23 Provinces, autonomous regions, and municipalities directly under the Central Government may, in light of local conditions, formulate detailed implementation rules.
Article 24 Units and individuals who have conscientiously implemented these measures and made outstanding achievements in the health care of childcare institutions shall be commended and rewarded by the health administrative departments and education administrative departments of people's governments at all levels.
Article 25 The "Health Care Work Specifications for Nursery Schools" shall be formulated by the Ministry of Health.
Article 26 These Measures shall be implemented as of November 1, 2010. The "Administrative Measures for the Health Care of Nursery Schools and Kindergartens" jointly issued by the Ministry of Health and the former State Education Commission on December 1, 1994 was repealed simultaneously.
