Chapter 1 General Provisions on Safety Management and Supervision of Pressure Pipelines

First
In order to ensure the safe operation of pressure pipelines and protect the safety of people's lives and property, these regulations have been formulated in accordance with the "Technology" and relevant laws and regulations.
Article 2
The pressure pipelines referred to in these Regulations are special equipment which may be used in production and daily life, which may cause dangers such as explosion or poisoning.
Pressure pipelines are divided into industrial pipelines, public pipelines and long-distance pipelines according to their purpose.
Article 3
This provision applies to pipelines and their ancillary facilities that meet one of the following conditions:
(1) Pipelines for transporting medium with a degree of toxicity as specified in GB5044 "Classification of the Degree of Hazard of Occupational Exposure to Poisons";
(2) Pipes transporting Class A and B media with fire hazards specified in GB50160 "Code for Fire Protection Design of Petrochemical Enterprises" and GBJ16 "Code for Fire Protection Design of Buildings";
(3) Pipes with a maximum working pressure of 0.1 MPa or more (gauge pressure, the same below), and the transmission medium is gas (steam) or liquefied gas;
(4) Pipelines with a maximum working pressure of 0.1 MPa or more and the transporting medium being flammable, explosive, toxic, corrosive or liquids with a maximum working temperature above the boiling point;
(5) Auxiliary facilities and safety protection devices for pipelines specified in the preceding four items.
Article 4
This provision does not apply to the following pipelines;
(1) The pipeline to which the equipment body belongs;
(B) pipelines on military equipment, vehicles and nuclear installations;
(3) Pipes for conveying non-toxic, non-flammable, non-corrosive gases whose nominal diameter is less than 150mm and whose maximum working pressure is less than 1.6Mpa;
(4) Domestic gas pipes after the last valve before entering the house (residential building, courtyard) and heat pipes after heat points (excluding heat points).
The fifth
Units that design, manufacture, install, use, inspect, repair, and repair pressure pipelines must implement these regulations.
The competent department in charge of the design, manufacture, installation, use, inspection and repair of the pressure pipeline shall be responsible for the safety management of the pressure pipeline of the affiliated enterprise.
Article 6
The boiler and pressure vessel safety supervision agency of the Ministry of Labor is responsible for safety supervision of safety pressure pipelines.
The agency in charge of the safety supervision of boilers and pressure vessels at the labor administrative department at or above the county level is responsible for the safety supervision of pressure pipelines within its administrative area.
Article 7
Relevant authorities should perform the following duties:
(1) Carry out and implement relevant safety laws, regulations and technical regulations and standards for pressure pipelines, and establish and improve safety management systems for various pressure pipelines in this department;
(2) Organize and review the design of the pressure management nominal project for new construction, reconstruction, and expansion of the department in accordance with relevant regulations, supervise and urge inspection of construction quality, and organize completion acceptance;
(3) To formulate annual plans and long-term plans for the pressure management and safety management of the department, organize and help relevant units to inspect, assess and rectify hidden dangers of major accidents in pressure pipelines, eliminate hidden dangers, and ensure safety;
(4) Reporting pressure pipeline accidents in a timely manner in accordance with relevant regulations, and participating in or organizing accident investigation and handling;
(5) Responsible for organizing the safety inspection, evaluation and assessment of pressure pipelines in this department, commend the advanced, summarize and exchange experience in pressure pipeline safety work;
(6) Organizing research and promotion of advanced safety science and technology and safety production management methods for pressure pipelines;
(7) Carrying out publicity and education on safety of pressure pipelines, responsible for organizing training for safety managers of pressure pipelines;
(8) Safety management of other pressure pipelines in accordance with relevant regulations.
eighth
Pressure pipeline users shall be responsible for the safety management of pressure pipelines of their own units and shall perform the following duties.
(1) There shall be full-time or part-time professional and technical personnel responsible for the safety management of pressure pipelines;
(2) Pressure pipelines and their safety facilities must comply with relevant national regulations;
The newly built, rebuilt, expanded pressure pipelines and their safety facilities do not have the right to refuse acceptance when they do not comply with relevant state regulations;
(3) Establishing technical files and registering with the local (municipal) level of the enterprise or the county-level labor administrative department entrusted by it;
(4) Provide safety technical training for pressure pipeline operators and pressure pipeline inspectors;
(5) Formulate a regular inspection plan for pressure pipelines, and arrange regular inspection and maintenance of auxiliary instruments, safety protection devices, and measurement and control devices;
(6) Measures shall be taken to rectify the hidden dangers of accidents in a timely manner, and the hidden dangers of major accidents shall be reported in writing to the competent authorities at or above the provincial level (including the provincial level, the same below) and labor administrative departments above the provincial level;
7. Establish a line inspection system for pressure pipelines that transport combustible, explosive or toxic media, formulate emergency measures and rescue plans, establish rescue teams as needed, and conduct regular drills;
(8) timely and truthfully report pressure pipeline accidents to competent authorities and local labor administrative departments in accordance with relevant regulations, and assist in accident investigation and aftercare and carefully summarize experiences and lessons to prevent accidents;
(9) Other pressure pipeline safety management work in accordance with relevant regulations.
Article 9
The management personnel, inspectors and operators of pressure pipelines shall strictly abide by relevant safety laws, regulations, technical regulations, standards and the safety production system of the enterprise.
Section I General Provisions
Article 10 The design unit of a pressure pipeline shall obtain a design qualification certificate issued by the relevant competent department at or above the provincial level and report it to the labor administrative department at or above the provincial level for the record.
The pressure pipeline design unit shall be responsible for the safety technical performance of the designed pressure pipeline.
Article 11 Manufacturers of products such as pipes, fittings, valves, flanges, compensators, and safety protection devices for pressure pipelines (hereinafter referred to as manufacturing units) shall report to the labor administrative department at or above the provincial level or the place authorized by the provincial labor administrative department ( The municipal (level) labor administrative department applies for security registration.
The review of safety registration is carried out by the Ministry of Labor in conjunction with an evaluation agency recognized by the relevant competent authority at the same level.
The manufacturing unit shall be responsible for the safety and quality of its products. The product should be type tested before being put into production.
The Ministry of Labor is responsible for the review and approval of the qualification of the type testing unit, and issues a qualification certificate for the type testing unit.
Article 12 The pressure pipeline safety unit must hold a pressure pipeline installation license issued by the labor administrative department.
The appraisal of the qualification approval of the pressure pipeline installation unit shall be conducted by the labor administrative department in conjunction with the appraisal agency approved by the relevant competent authority.
The pressure pipe installation approval certificate is uniformly printed by the Ministry of Labor and issued by the Ministry of Labor and the provincial labor administrative department.
The pressure pipeline installation unit shall be responsible for the safety and quality of the pressure pipeline engineering installed by it.
Article 13 Newly constructed, expanded and rebuilt pressure pipelines shall be supervised and inspected by a qualified inspection unit for their installation quality; in-use pressure pipelines shall be regularly inspected by a qualified inspection unit.
The qualification examination of the inspection unit shall be conducted in accordance with Articles 25 and 28 of these regulations.
Article 14 Pressure pipeline repair and transformation units have certain conditions. When major reconstruction of pressure pipelines is carried out, the technical and management requirements shall be consistent with the requirements for new pressure pipelines.
Article 15 Welders engaged in the welding of pressure pipelines and inspection personnel without loss inspection must obtain the qualification certificate for special operations personnel issued by the labor administrative department in accordance with relevant regulations.
Article 16 The labor administrative department shall conduct safety supervision on the design, manufacture, installation, use, inspection, repair, and transformation of pressure pipelines in accordance with these regulations, and determine site safety supervision based on the actual situation in the area.
Article 17 The labor administrative department shall statistics, report and handle accidents in accordance with relevant regulations.
Section 2 Safety Inspection of Industrial Pipelines
Article 18 Industrial pipelines are classified according to their degree of hazard, and safety supervision is carried out according to the classification.
Article 19 The user-designed industrial pipeline must be approved by its provincial competent department and filed with the provincial labor administrative department for the record.
Article 20 The use of units to install industrial pipelines must be approved by their provincial competent department and filed with the provincial labor administrative department.
Section 3 Safety Supervision of Public Pipelines
Article 21 The construction of public pipelines must meet the requirements of urban planning, fire protection and safety. In the selection of the line, the consent of the local labor administrative department shall be obtained.
Article 22 The design review and completion acceptance of public pipeline projects shall be attended by safety supervisors dispatched by the local labor administrative department.
Article 23 No unit or individual may build buildings, structures and stacked articles on public pipelines.
Article 24 The Ministry of Labor is responsible for the safety supervision of long-distance pipelines.
The personnel engaged in safety supervision of long-distance pipelines are trained, evaluated, and issued certificates by the Ministry of Labor, and their work is responsible to the Ministry of Labor.
Article 25 The inspection units of long-distance pipelines shall have the corresponding qualifications. The qualification examination shall be jointly conducted by the Ministry of Labor together with relevant competent authorities at the same level, and the inspection qualification certificate shall be issued by the Ministry of Labor.
Article 26 Prior to the installation and construction of long-distance pipelines for new construction, expansion and reconstruction, the construction unit shall file a record with the Ministry of Labor. The completion inspection of the project shall be attended by a safety supervisor sent by the Ministry of Labor.
Article 27 Units engaged in the inspection of industrial pipelines and public pipelines shall have certain conditions and obtain corresponding inspection qualifications in accordance with the requirements of these regulations.
Article 28 The qualifications of industrial pipeline and public pipeline inspection units affiliated to relevant departments at or above the provincial level shall be examined by the Ministry of Labor together with relevant competent departments at the same level.
Article 29 Pressure pipeline inspectors must be organized by the labor administrative department at or above the provincial level for examination and obtain corresponding qualification certificates.
Article 30 The inspection unit and inspector must engage in inspection work within the scope permitted by the inspection unit qualification certificate and inspector qualification certificate.
The inspection unit shall be responsible for the correctness of the inspection results issued by it.
Article 31 The inspection unit undertaking pressure pipeline safety supervision and inspection and import and export inspection shall have a fair third party status.
Inspection units and their personnel engaged in supervision and inspection shall not engage in the design, manufacture, installation, repair and transformation of pressure pipelines and related distribution activities.
Article 32 The inspection unit and inspector shall keep the commercial secrets of the inspected unit.
Article 33 Inspection units and inspectors shall accept supervision and inspection and professional guidance from the labor administrative department.
Article 34 Inspection units engaged in pressure pipeline inspection shall collect inspection fees in accordance with relevant charging methods.

Regulations on Safety Management and Supervision of Pressure Pipelines Chapter II Penalties

Article 35 In any of the following circumstances, the labor administrative department shall order correction and may impose a fine:
(1) The pressure pipeline design unit that has not applied for the filing procedure designs the pressure pipeline;
(2) A manufacturing unit that has not applied for safety registration procedures manufactures pipes, fittings, valves, flanges, compensators and safety protection devices for pressure pipes;
(3) An installation unit that has not applied for a pressure pipeline installation permit installs a pressure pipeline;
(4) Newly constructed, expanded, or reconstructed pressure pipelines are put into operation without supervision and inspection and completion acceptance.
(5) Units that have not gone through registration of pressure pipelines use pressure pipelines;
(6) Units that have not obtained the qualification for pressure pipeline inspection are engaged in pressure pipeline inspection work;
(7) The user fails to conduct regular inspections of the pressure pipeline in accordance with relevant regulations.
Article 36 The pressure pipeline inspectors, non-destructive testing personnel and welders in one of the following situations shall be ordered to correct by the labor administrative department, and if the fine is serious, the qualification certificates of the relevant personnel may be temporarily suspended or revoked;
(1) Undocumented employment
(2) Engaging in pressure pipeline inspection, welding or non-destructive testing beyond the scope permitted by the qualification certificate.
Article 37 In any of the following circumstances, the labor administrative department shall order it to make corrections and may impose a fine. In serious cases, its qualification certificate may be temporarily suspended or revoked. Those who cause economic losses to the using unit or other units shall bear the corresponding economic compensation liability, and shall be investigated for criminal liability in accordance with the law;
(1) the accident caused by the safety and quality problems of the pressure pipeline due to the reasons of the design, manufacture and installation of the pressure pipeline;
(2) An accident has occurred due to missed inspection, wrong inspection, or misjudgment of a pressure pipeline inspection unit;
(3) An accident occurred in the pressure pipeline due to poor management of the user.
Article 38 The above fines shall be implemented in accordance with relevant regulations.
Article 39 Terms of these Regulations:
(1) Industrial pipelines refer to the technological pipelines, public works pipelines and other auxiliary pipelines used by enterprises and institutions to transport process media.
(2) Public pipelines refer to gas or thermal pipelines for public utilities or civilian use within the limits of cities or towns.
(3) Long-distance pipelines refer to the pipelines used to transport commodity media between production areas, storages, and units of use.
Article 40 The design and acceptance of pressure pipelines in foreign-imported installations may be carried out in accordance with the specifications or standards stipulated in the agreement, among which important safety technical indicators shall not be lower than relevant Chinese regulations.
Article 41 The import and export supervision and management measures for pipes, fittings, valves, flanges, compensators, auxiliary instruments and safety protection devices used in pressure pipelines shall be separately formulated by the Ministry of Labor.
Article 42 The safety management and supervision of domestic gas pipelines after the last valve before entering the household (residential building, courtyard) are separately stipulated.
Article 43 These Provisions shall become effective on July 1, 1996.
