Article 28 In any of the following situations, a medical and health institution shall be corrected by the health authority of the local people s government at or above the county level within a time limit based on the division of responsibilities and given a warning; if it is not corrected within the time limit, it shall be in accordance with the nurses' provisioning standard prescribed by the health authority of the State Council And the number of nurses legally practising in medical and health institutions shall be deducted from their diagnosis and treatment subjects, or their practice activities shall be suspended for more than 6 months and less than 1 year; the medical and health institutions organized by the state shall be held responsible if one of the following circumstances is serious: The persons in charge and other persons directly responsible shall be punished according to law:
(1) In violation of the provisions of these regulations, the number of nurses allocated is lower than the nurses provision standard prescribed by the health department of the State Council;
(2) Permitting persons who have not obtained a nurse's practice certificate or nurses who have not gone through the procedures for changing the practice site and extending the validity of the practice registration in accordance with these regulations to engage in the nursing activities stipulated in the technical specifications for diagnosis and treatment in this institution.
Article 29 If a medical institution has one of the following circumstances, it shall be punished in accordance with the relevant laws and administrative regulations. If a state-owned medical institution has one of the following situations and the circumstances are serious, it shall also be responsible to the supervisor in charge. Personnel and other persons directly responsible shall be punished according to law:
(1) Failure to implement relevant state regulations on wages and benefits;
(2) failing to pay the full amount of social insurance expenses for nurses engaged in nursing work in this institution;
(3) failing to provide nurses with sanitary protective articles, or failing to take effective sanitary protective measures or medical care measures;
(4) Nurses who work in hard and remote areas, or engage in work that is in direct contact with toxic and harmful substances and is at risk of infection and infectious diseases, have not been given subsidies in accordance with relevant state regulations.
Article 30 In any of the following situations, a medical and health institution shall be ordered to make corrections within a time limit by the health department of the local people's government at or above the county level, and given a warning:
(1) Failure to formulate and implement on-the-job training plans for nurses in this institution or to ensure that nurses receive training;
(2) Failure to perform nurse management duties in accordance with the regulations.
Article 31 If a nurse has any of the following situations in his practice activities, the health department of the local people s government at or above the county level shall order correction and warning based on the division of responsibilities; if the circumstances are serious, his practice shall be suspended for more than 6 months and less than 1 year Activities until the nurse license is revoked by the original licensing department:
(1) failing to notify the physician immediately when the patient is found to be in critical condition;
(2) failing to make or report a medical order in violation of laws, regulations, rules or technical specifications of diagnosis and treatment in accordance with the provisions of Article 17 of these Regulations;
(3) leaking patient privacy;
(4) Those who have emerged from natural disasters or public health events that seriously threaten the life and health of the public and are not obedient to arrange for medical assistance.
If a nurse causes a medical accident in his practice activities, he shall bear legal responsibility in accordance with the relevant regulations for handling medical accidents.
Article 32 If a nurse's practice certificate is revoked, he shall not apply for practice registration within 2 years from the date of the practice certificate being revoked.
Article 33 Disrupting the medical order, hindering nurses from practicing according to law, insulting, threatening, assaulting nurses, or other violations
Acts of nurses with lawful rights and interests shall be punished by the public security organs in accordance with the provisions of the Law on Penalties for Public Security Management; if a crime is constituted, criminal responsibility shall be investigated in accordance with the law.
Chapter VI Supplementary Provisions
Article 34 Persons who have obtained a nurse practice certificate or a nursing professional and technical title and engaged in nursing activities in accordance with relevant state regulations before the implementation of these regulations shall pass the examination by the competent health department of the people's government of the province, autonomous region, or municipality directly under the State of Practice to renew their practice. certificate.
Before the implementation of these regulations, medical and health institutions that have not yet reached the nurse provisioning standards shall follow the implementation steps prescribed by the competent health department of the State Council and reach the nurse provisioning standards within 3 years from the date of implementation of these regulations.
Article 35 These Regulations shall become effective on May 12, 2008.
