Administrative Measures of the People's Bank of China for Collection and Appraisal of Counterfeit Currency
Chapter I General Provisions
The first is to regulate the collection and appraisal of counterfeit currency, and to protect the legitimate rights and interests of currency holders. Method.
Article 2 These Measures shall apply to the collection of counterfeit currency by financial institutions that handle money deposits and withdrawals and foreign currency exchange operations, and the People's Bank of China and its authorized appraisal agencies to verify the authenticity of currencies.
Article 3 The currencies referred to in these measures refer to RMB and foreign currencies. Renminbi refers to the currency issued by the People's Bank of China in accordance with law, including banknotes and coins; foreign currency refers to the legal currency of other countries or regions that can be exchanged in China (except Hong Kong Special Administrative Region, Macau Special Administrative Region and Taiwan).

Chapter II Collection of Counterfeit Currency
Article 6 When a financial institution discovers counterfeit currency while conducting business, two or more business personnel of the financial institution will collect it in person. The counterfeit RMB banknotes should be stamped with the words counterfeit coins; the counterfeit foreign currency banknotes and various counterfeit coins should be sealed with a special bag in a uniform format, and the seal should be stamped with the counterfeit coins and sealed in the special bags. The detailed items such as currency, coupon type, denomination, number of Zhang (pieces), prefix number, consignee, reviewer's name stamp, etc. are marked on it. The financial institution that collects counterfeit currency (hereinafter referred to as the "collection unit") issues to the holder the "Fake Currency Collection Certificate" uniformly printed by the People's Bank of China, and informs the holder that if he has any objection to the authenticity of the currency collected, he can notify China A local branch of the People's Bank of China or a local appraisal agency authorized by the People's Bank of China applies for appraisal. Article 7 If a financial institution has any of the following situations in the process of collecting counterfeit currency, it shall immediately report to the local public security organ and provide relevant clues:
(1) One or more false 20 RMB (pieces) (including 20 pieces) and more than 10 foreign currency fakes (including 10 pieces) are found at one time;
(2) It belongs to the use of new counterfeiting methods to make fake currency;
(3) There are clues for manufacturing and selling counterfeit currency;
(4) The holder does not cooperate with the collection action of the financial institution.
Article 8 Personnel handling the collection of counterfeit currency shall obtain the Qualification Certificate for Anti-counterfeit Currency Posting. The "Anti-counterfeit Currency Qualification Certificate" is printed by the People's Bank of China. The branches of the People's Bank of China, the business management department, and the provincial (capital) city center sub-branch are responsible for training, examinations, and issuing the "Anti-counterfeit Currency Qualification Certificate" for relevant business personnel of financial institutions in their provinces (autonomous regions and municipalities).
Article 9 Financial institutions shall separately manage the physical objects of counterfeit currency collected, and establish a register of custody of counterfeit currency collection and collection.
Chapter III Identification of Counterfeit Currency
Article 10 The holder has objections to the authenticity of the collected currency, and may, within 3 working days from the date of collection, hold a "counterfeit currency collection certificate" directly or through the collection unit to the local branch of the People's Bank of China or the People's Bank of China Authorized local appraisal agency submits a written appraisal application. Branches of the People's Bank of China and appraisal agencies authorized by the People's Bank of China shall provide free services for appraising the authenticity of currencies. After appraisal, they shall issue a Money Authenticity Appraisal Certificate uniformly printed by the People s Bank of China, and affix the special stamp for currency appraisal and Appraiser's name stamp. The appraisal agency authorized by the People's Bank of China shall publicize the authorization certificate at the business premises.
Article 11 The branches of the People's Bank of China and the authentication institutions authorized by the People's Bank of China shall, within 2 working days from the date of receipt of the application for authentication, notify the collection unit to submit the currency to be authenticated.
The collecting unit shall, within 2 working days from the date of receiving the notification from the appraisal unit, send the currency to be appraised to the appraisal unit.
Article 12 The branches of the People's Bank of China and the appraisal agencies authorized by the People's Bank of China shall issue a "Money Authenticity Appraisal Certificate" within 15 working days from the date of acceptance of the appraisal. If the situation cannot be completed within the prescribed time limit due to complicated circumstances, it can be extended to 30 working days, but the reasons must be explained to the applicant or the applicant in writing.
Article 13 For RMB banknotes stamped with the words "counterfeit currency", if they are authenticated as real currency, the appraisal unit shall pay back the entire coupon to the holder in accordance with the denomination and return the holder's "counterfeit currency receipt certificate", Renminbi stamped with "counterfeit currency" is treated as damaged yuan; if it is identified as counterfeit currency, it shall be confiscated by the appraisal unit, and a "currency authenticity certificate" and "counterfeit currency confiscation receipt" shall be issued to the collecting unit and the holder.
For the collected foreign currency banknotes and various coins that have been identified as real currency, the appraisal unit shall return the payment unit to the holder, and recover the "counterfeit currency collection voucher"; if it is identified as counterfeit currency, the appraisal unit shall return the counterfeit currency to the payment unit Collect it in accordance with the law, and issue a Certificate of Authenticity of Currency to the collecting unit and holder.
Article 14 When a branch of the People s Bank of China and an appraisal agency authorized by the People s Bank of China appraise the authenticity of a currency, at least two appraisers shall participate at the same time and make an appraisal conclusion.
Article 15 When any branch of the People's Bank of China finds counterfeit Renminbi when retiring the repatriated funds released by financial institutions, it shall be confiscated after identification, and a "counterfeit currency confiscation receipt" shall be issued to the disbursed unit, and it shall be required to make up the same amount. Article 16 The holder has any objection to the specific administrative action of the financial institution regarding the collection or identification of counterfeit currency, and he / she may report it directly to the direct within 60 working days from the date of receipt of the Counterfeit Currency Collection Certificate or Currency Authentication Certificate. The holder has objection to the specific administrative behavior of the counterfeit currency appraisal made by the branch of the People's Bank of China, and can apply to its superior institution for administrative reconsideration within 60 working days from the date of receipt of the Certificate of Authenticity of Currency, or File an administrative lawsuit in accordance with the law.
Chapter IV Penalties
Article 17 If a financial institution commits one of the following acts but has not constituted a crime, the People's Bank of China shall issue a warning and a fine, and at the same time instruct the financial institution to impose corresponding disciplinary sanctions on the relevant supervisors and other persons directly responsible:
(1) Those who found counterfeit currency but did not collect it;
(2) failing to collect counterfeit currency in accordance with the procedures prescribed in these Measures;
(3) Those who should report to the People's Bank and public security organs without reporting;
(4) Withholding or processing the counterfeit counterfeit currency without permission, or causing the counterfeit counterfeit currency already collected to flow into the market again.
Where the above acts involve counterfeit Renminbi, a financial institution shall be fined between 1,000 yuan and 50,000 yuan; if the counterfeit foreign currency is involved, a financial institution shall be fined 1,000 yuan or less.
Article 18 If an appraisal agency authorized by the People's Bank of China commits one of the following acts but has not constituted a crime, the People's Bank of China shall issue a warning and a fine, and at the same time instruct the financial institution to impose corresponding disciplinary sanctions on relevant persons in charge and other directly responsible persons:
(1) Refusal to accept applications for currency authenticity verification from holders and financial institutions;
(2) Failure to identify counterfeit currency in accordance with the procedures prescribed in these Measures;
(3) Withholding or processing the counterfeit currency for identification or collection without permission, or re-entering the collected and confiscated counterfeit currency into the market.
Where the above acts involve counterfeit Renminbi, a fine of 1,000 yuan to 50,000 yuan shall be imposed on the authorized appraisal agency; if the counterfeit foreign currency is involved, the authorized institution shall be fined 1,000 yuan or less.
Article 19 If the staff of the People's Bank of China commits one of the following acts but has not constituted a crime, the person in charge directly responsible and other persons directly responsible shall be given administrative sanctions according to law:
(1) Failure to identify counterfeit currency in accordance with the procedures prescribed in these Measures;
(2) Refusing to accept applications for authenticity or re-authentication of currencies submitted by holders, financial institutions, and authorized appraisal agencies;
(3) Withholding or disposing of counterfeit coins for identification, seizure, or confiscation without permission, or causing the seized or confiscated counterfeit coins to flow back into the market.
