Chapter I General Provisions
Article 1 These regulations are formulated in accordance with the Labor Law and related regulations to ensure the safe use of chemicals in the workplace and to protect the safety and health of workers.
Article 2. These regulations apply to units and personnel who produce, manage, transport, store and use chemicals.
Article 3 The use of chemicals in the workplace referred to in these regulations refers to the work activities where workers are exposed to chemicals due to their work; the chemicals referred to in these regulations refer to various chemical elements, compounds or mixtures; the dangers referred to in these regulations Chemicals refer to commonly used hazardous chemicals classified according to the national standard GB13690.
Article 4 Units that produce, operate, transport, store and use dangerous chemicals shall publicize the knowledge of protection of dangerous chemicals and first aid methods for chemical accidents to surrounding units and residents.
Article 5 The labor administrative departments of the people's governments at or above the county level shall supervise and inspect the safe use of chemicals in workplaces within their respective administrative areas.
Chapter II Duties of Production Units
Article 6 Production units shall implement the "Safety Management System for Chemical Enterprises" and relevant national regulations and standards, and register hazardous chemicals with the chemical industry administrative department.
Article 7 The production unit shall identify the hazards of the chemicals produced and label them.
Article 8 The production unit shall affix "Dangerous Chemical Safety Labels" (hereinafter referred to as safety labels) for the produced dangerous chemicals, and fill in "Dangerous Chemicals Safety Technical Instructions" (hereinafter referred to as safety technical specifications).
Article 9 The production unit shall indicate the danger at the operation site of hazardous chemicals by means of "safely known cards" or "safety signs".
Article 10 When a production unit produces hazardous chemicals, if the safety technical specification is completed, if it involves commercial secrets, it may not be filled in after the approval of the chemical registration department, but the main hazardous characteristics of the hazardous chemical must be listed.
Article 11 The safety data sheet is replaced every five years. If new hazardous characteristics are discovered during this period, within six months after the release of relevant information, the production unit must modify the safety technical specifications accordingly and provide them to the operating, transportation, storage, and use units.
Chapter III Duties of Users
Article 12 The chemicals used by the users shall be identified, dangerous chemicals shall be provided with safety labels, and safety technical instructions shall be provided to the operators.
Article 13 When purchasing hazardous chemicals, the user must check the safety label on the packaging (or container). If the safety label comes off or is damaged, it should be subsidized after inspection and confirmation.
Article 14 When a chemical purchased by a user needs to be transferred or repacked into another container, its content shall be indicated. For hazardous chemicals, safety labels should be affixed to the containers after transfer or repackaging; containers that contain dangerous chemicals must not be replaced with original safety labels before being decontaminated.
Article 15 The hazards caused by the hazardous chemicals used in the workplace by the user unit shall be regularly tested and evaluated, and the results of the test and evaluation shall be documented. If the concentration of hazardous chemicals exposed to the operator should not be higher than the nationally prescribed standards, the user should use it under conditions that ensure safe operation.
Article 16 The user shall adopt the following methods to eliminate, reduce and control the harm caused by hazardous chemicals in the workplace:
(1) choose non-toxic or low-toxic chemical alternatives;
(B) use technologies that minimize or reduce hazards;
(3) adopt engineering control measures (such as isolation, containment, etc.) that can eliminate or reduce hazards;
(4) adopting an operating system and operating time that can reduce or eliminate hazards;
(5) Take other labor safety and health measures.
Article 17 The user shall provide first aid facilities at the workplace of hazardous chemicals and provide emergency treatment methods.
Article 18 The user unit shall remove chemical waste and wash waste containers containing dangerous chemicals in accordance with relevant state regulations.
Article 19 The user shall indicate the danger of equipment containing dangerous chemicals in the form of color, label, label, etc.
Article 20 The user unit shall disclose relevant safety and health information of hazardous chemicals to employees, educate employees to identify safety labels, understand safety technical specifications, master necessary emergency treatment methods and self-rescue measures, and regularly use workplace safety for employees. Chapter IV Responsibilities of Business, Transportation and Storage Units
Article 21 Chemicals handled by business units shall be labeled. Dangerous chemicals in operation must have safety labels and safety technical specifications. When importing dangerous chemicals, there should be a Chinese safety technical manual that meets the requirements of this regulation, and the Chinese safety label should be affixed to the packaging. When exporting hazardous chemicals, the safety technical instructions should be provided to the foreign party. For hazardous chemicals banned in our country, and foreign countries need hazardous chemicals, the banned matters and reasons should be explained to the foreign party.
Article 22 The transport unit must implement national standards and relevant regulations such as the General Technical Conditions for Packaging of Dangerous Goods and the Marking of Packing for Dangerous Goods, and have the right to require the shipper to provide a safety technical specification for dangerous chemicals.
Article 23 The storage of dangerous chemicals must meet the national standards and relevant regulations of the General Rules for the Storage of Commonly Used Chemical Dangerous Goods.
Chapter V Obligations and Rights of Employees
Article 24 Employees shall abide by labor safety and health rules and regulations and safe operating procedures, and shall promptly report that they may cause harm

Article 25 Employees shall adopt reasonable methods to eliminate or reduce unsafe factors in the workplace.
Article 26. Employees have the right to refuse imitation to command or force risky operations, and refuse to imitate acts that endanger personal safety and health.

Article 27 Employees have the right to:
(1) Information on the characteristics, hazardous ingredients, safety labels, and safety technical specifications of chemicals used in the workplace;
(B) information on hazardous chemicals that may cause safety and health hazards in the course of their work;
(3) Training in safety technology, including training in prevention, control and prevention of dangerous methods and training in emergency handling or emergency measures.

Chapter VI Penalties
Article 28 If a unit that produces dangerous chemicals fails to register with a designated unit, the labor administrative department of the people's government at or above the county level shall order the relevant unit to make corrections within a time limit; if it does not change within the time limit, it may be fined up to 10,000 yuan.
Article 29 If the hazardous chemicals produced by the production unit fail to complete the "Safety Technical Instructions" and "Safety Label", the labor administrative department of the people's government at or above the county level shall order the relevant units to make corrections within a time limit; Fines up to 10,000 yuan.
Article 30 If an operating unit operates dangerous chemicals without safety technical specifications and safety labels, the labor administrative department of the people's government at or above the county level shall order the relevant units to make corrections within a time limit; if they do not change within the time limit, they may be fined up to 10,000 yuan.
Article 31 For those who conceal the characteristics of dangerous chemicals without implementing this provision, the labor administration department of the people's government at or above the county level shall seize the sealed product on site and impose a fine of less than 10,000 yuan; if a crime is constituted, the judicial organ shall according to law Investigate the criminal responsibility of the person concerned.
Article 32 Where there is no first-aid facilities and emergency treatment methods in hazardous chemical workplaces, the labor administrative department of the people's government at or above the county level shall order the relevant units to make corrections within a time limit, and may impose a fine of less than 1,000 yuan; A fine below 10,000 yuan.
Article 33 If the storage of dangerous chemicals does not meet the national standards of the General Rules for the Storage of Commonly Used Chemical Dangerous Goods, the labor administrative department of the people's government at or above the county level shall order the relevant units to make corrections within a time limit and may impose a fine of less than 1,000 yuan.
Chapter VII Supplementary Provisions
Article 34 These regulations shall come into force on January 1, 1997. [1]
