What is a Drug Rehabilitation Center?
A detox center refers to a place where drug addicts are concentrated on abstaining from drug use, injecting drugs, and addiction. It is a place where drug users are treated. General detoxification centers are equipped with related detoxification drugs and related medical staff. The classification of detox centers mainly includes voluntary detox centers, community detox centers, and compulsory isolation detox centers.
Detox
- Since China is currently unable to implement a medical treatment model for foreign detoxification, China's current policy is mainly on compulsory isolation and detoxification. China's detoxification clinics are divided into three categories: the first category is compulsory isolation and detoxification centers under the control of public security organs; the second category is compulsory isolation and detoxification centers under the administration of justice; the third category is detoxification medical institutions under the supervision of health departments. According to regulations, persons who have been subjected to compulsory isolation and detoxification will be subjected to compulsory isolation and detoxification at public security organs' quarantine detoxification centers for 3 to 6 months, up to a maximum of 12 months. The quarantine detoxification place transferred to the judicial administration department will continue to implement compulsory quarantine detoxification.

- Chapter I General Provisions
- Article 1 In order to strengthen and regulate the management and ensure the smooth progress of compulsory detoxification, these Measures are formulated in accordance with the "Compulsory Detoxification Measures" of the State Council and relevant regulations.
- Article 2 The compulsory detoxification center is a place where the public security organs adopt administrative compulsory measures in accordance with the law to carry out physiological detoxification, psychological correction, moderate labor, physical rehabilitation, and legal and moral education for drug addicts and injecting drug addicts within a certain period of time.
- Article 3 The compulsory detoxification center shall adhere to the policy of combining detoxification treatment with education, and follow the principles of lawful, strict, scientific, and civilized management to achieve standardized management, hospitalization of treatment, schooling of education, labor of rehabilitation, and environmental gardening.
- Article 4 The establishment of a compulsory detoxification center shall be proposed by the public security organs of the people's governments at or above the county level in accordance with the unified planning of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government. When the public security organs of the railway, transportation, and civil aviation systems at or above the county level need to set up compulsory detoxification stations, they should report to the Ministry of Railways Public Security Bureau, the Ministry of Transportation Public Security Bureau, and the Civil Aviation Administration of Public Security Bureau for approval, and report to the Ministry of Public Security for the record. Public security organs shall not establish joint venture drug rehabilitation centers with any unit or individual. The compulsory detoxification center must be set up separately with no less than 60 beds. Sites selected for compulsory detoxification should be kept as far away as possible from government offices, schools, residential areas, kindergartens, and other prosperous areas with dense crowds, and away from noisy and polluted places.
- Article 5 The management of a compulsory detoxification center is the responsibility of the public security organ that established the compulsory detoxification center. The name of the compulsory detoxification center is collectively referred to as "×× public security agency compulsory detoxification center".
- Article 6 One director and one to three deputy directors of the compulsory detoxification institute shall be equipped with police officers such as discipline, medical care, finance and accounting according to their work needs.
- Compulsory detoxification centers should be equipped with police according to the number of beds: if the number of beds is less than one hundred, generally there are not less than 15 people, of which, there should be no less than four medical personnel; if there are more than one hundred beds, the police should generally be based on the number of beds 15% equipped, of which, medical staff must not be less than 5% of the number of beds. The compulsory detoxification center shall be equipped with a certain number of female police officers and a corresponding number of work staff according to the work needs. Directors, deputy directors, and police officers shall have college education or above; doctors shall have professional and technical titles of doctors and above, nurses shall have professional and technical titles or be trained in related professional knowledge, and accounting staff shall have professional and technical titles in accounting.
- Article 7 The policemen of compulsory detoxification centers must enforce the law impartially, observe strict discipline, be honest and clean, and must not commit the following acts:
- (1) scolding, corporal punishment, insulting drug addicts and infringing their legal rights and interests;
- (2) soliciting and accepting the property of drug addicts and their relatives;
- (3) Misappropriating, damaging or disposing of the property confiscated or kept on its own;
- (4) providing narcotic drugs and psychotropic drugs to drug addicts in violation of regulations;
- (5) Private drug addicts.
- Article 8 The capital construction investment and required funds of compulsory detoxification centers shall be reported to the planning department and financial department of the people's government at the same level for inclusion in the capital construction plan and financial budget of the same level according to the administrative affiliation.
- Chapter II Entrance
- Article 9 Compulsory detoxification institutions shall accept detoxification personnel on the basis of the "Decision of Compulsory Detoxification" issued by the public security organs of the people's governments at or above the county level.
- Article 10 The detoxification personnel received by the compulsory detoxification center shall complete the Registration Form for Compulsory Detoxification Personnel and conduct a health check on it and complete the Health Checklist for Compulsory Detoxification Personnel. In any of the following circumstances, it is not appropriate to enter the compulsory detoxification center The compulsory detoxification center shall issue the conclusion of the medical examination and retire the public security organ that made the decision in accordance with the law to make a decision on detoxification outside the time limit:
- (1) suffering from acute infectious diseases (excluding sexually transmitted diseases) or other serious diseases;
- (2) Being pregnant or breastfeeding a baby under the age of one year;
- (3) Others that are not suitable for detoxification in compulsory detoxification centers. After the situation prescribed in the preceding paragraph disappears, if the detoxified person outside the time limit has not detoxified and needs compulsory detoxification, the public security organ that made the decision shall make a compulsory detoxification decision and send it to the compulsory detoxification center to continue detoxification.
- Article 11 When a compulsory detoxification institution receives a detoxification person to enter the premises, it shall inform it of the rights it has enjoyed in accordance with the law and the regulations that it must abide by.
- Article 12 When a compulsory detoxification facility receives a detoxification person when entering the premises, it must inspect its body and the items it carries. Except for daily necessities, other properties are kept by the compulsory detoxification center, and the "Registration Form for Compulsory Detoxification Personnel's Property Custody Registration Form" is completed in duplicate, one is kept by the compulsory detoxification center, and the other is delivered to the detoxification officer. The compulsory detoxification center shall register the drugs found in the inspection and the contraband that shall be confiscated by law and shall be confiscated one by one, and issue the "Forfeiture List of Compulsory Detoxified Persons' Prohibited Items" in duplicate. Share with drug addicts. Confiscated items shall be handled in accordance with relevant regulations. The physical examination of female drug addicts should be performed by female staff.
- Article 13 The compulsory detoxification center shall establish the files of drug addicts in accordance with laws and relevant regulations and implement computer management. The contents of the file include: "Decision of Compulsory Detoxification", "Registration Form for Compulsory Detoxification Personnel", "Registration Form for Compulsory Detoxification Personnel", "Medical Checkup Form for Compulsory Detoxification Personnel", "Registration Form for Custody of Compulsory Detoxification Personnel Property", "Forbidden Items of Compulsory Detoxification Personnel Checklist, medical records of detoxification personnel, education records of conversation, "Approval Form for Extension of Compulsory Detoxification Period", "Decision for Extension of Compulsory Detoxification Period", "Notice of Decommissioning for Compulsory Detoxification Personnel", "Approval Form for Release of Compulsory Detoxification" Detoxification Certificate and other materials that need to be kept. If a detoxified person dies during the detoxification period, the compulsory detoxification center shall include the "Death Appraisal Certificate of the Compulsory Detoxified Person" and the "Death Notification of the Compulsory Detoxified Person" into its archives. Without the approval of the director of the compulsory detoxification center, no one may consult the files of drug addicts.
- Chapter III Management and Education
- Article 14 A compulsory detoxification center shall establish a strict management and education system that integrates education with management, combines discipline with education, and educates and rescues drug addicts.
- Article 15 The compulsory detoxification centers shall implement separate management of drug addicts according to gender, adulthood and underage. Female drug addicts are managed by female staff. The compulsory detoxification center shall be managed in accordance with the detoxification situation, and divided according to physical detoxification, psychological treatment, and physical rehabilitation.
- Article 16 The detoxification treatment area of a compulsory detoxification center is under closed management. Except for correctional, medical, and service personnel, no other person may enter the drug treatment area without the approval of the director.
- Article 17 The compulsory detoxification center implements a 24-hour on-duty inspection system. The staff on duty must adhere to their posts, and report problems in a timely manner and properly handle them.
- Article 18 The compulsory detoxification center shall conduct safety inspections on a regular or irregular basis to eliminate the hidden dangers of accidents in time to prevent accidents such as escape, suicide and other acts that endanger the safety of compulsory detoxification centers.
- Article 19 Compulsory detoxification centers may adopt protective measures such as special care or isolation to prevent drug addicts who may self-injury, self-harm or perform other harmful behaviors due to addiction.
- Article 20 The compulsory detoxification center shall educate the detoxification personnel to abide by the "Code of Conduct for Compulsory Detoxification Personnel" and the various rules and regulations of the compulsory detoxification center, obey management, cooperate with treatment, and receive education. For violations of the regulations, compulsory detoxification centers should be criticized and educated or warned separately according to the circumstances; violations of the "Regulations on Public Security Administration Punishments" shall be punished by public security organs affiliated to compulsory detoxification centers;
- Article 21 The compulsory detoxification center shall, in accordance with the actual situation of drug addicts, carry out planned, purposeful, and targeted education on the legal system, ethics, situation, policies, drug abuse hazards, and knowledge of sexually transmitted diseases and AIDS. The education of female drug addicts should be conducted by female police or two or more police.
- Article 22 The education of drug addicts can take the form of concentrated lectures, individual talks, social help, counselling by relatives and friends, and personal statements. The compulsory detoxification center shall organize the detoxification personnel to listen to radio, watch TV, read books and newspapers, visit and study, and edit and perform arts and programs to make their lives more active.
- Article 23 The compulsory detoxification center implements standardized management of the daily life of drug addicts. Discipline police should implement face-to-face direct management of drug addicts. They should be familiar with the basic situation of drug addicts in charge, grasp their ideological trends in a timely manner, and conduct targeted ideological education. Medical and nursing personnel should be kept informed of the treatment and physical rehabilitation of the detoxified personnel in charge.
- Article 24 For drug addicts who have confessed their own illegal and criminal behaviors, the compulsory detoxification center shall recommend relevant departments to lighten, mitigate or exempt punishment according to law; for drug addicts who report or expose other people's illegal or criminal behaviors or perform other meritorious acts, Compulsory detoxification centers should be rewarded. If a drug addict finds that the drug addict has committed other illegal or criminal acts that have not yet been dealt with, they shall be brought to the relevant departments for treatment in accordance with the relevant laws and regulations.
- Article 25 During the period of compulsory detoxification, the detoxification personnel has one of the conditions specified in Article 10 of these Measures, and it is not suitable to detoxify in the compulsory detoxification center. The Notice of Detoxification of Persons Outside the Time Limit allows the detoxification personnel to detoxify outside the time limit under the supervision and management of the local or temporary residence police station. Detoxification time outside the time limit is included in the compulsory detoxification period. If the detoxification period outside the time limit expires, and the body has been detoxified after inspection, the compulsory detoxification center shall go through the procedures for going out and issue a "Certificate of Lifting Compulsory Detoxification."
- Article 26 The compulsory detoxification center shall allow the family members of the drug addicts or the relevant personnel of their unit to visit, and the visits shall be arranged uniformly by the compulsory detoxification center. Visitors must abide by the relevant regulations of the compulsory detoxification centre. For those who violate the regulations, the compulsory detoxification center may warn or order to stop visiting. Articles that are carried or mailed to detoxification personnel must be inspected by the compulsory detoxification center to confirm that there are no contraband and registered before they can be delivered to the detoxification person.
- Article 27 When investigating drug addicts, the case-handling unit shall present the case-handling unit's certificate and valid credentials of the case-handling personnel, go through the registration formalities, and proceed with the approval of the director at the designated place in the office. When inquiring, there should be no less than two persons handling the case.
- Article 28 During the period of compulsory detoxification, if the immediate relatives are critically ill, die or have other legitimate reasons to temporarily leave the place, the local police station shall issue a certificate, and their relatives or units shall provide a written guarantee and be approved by the director. After reporting to the affiliated public security organs, they can leave the office. The period of absence shall not exceed three days, and the time of departure shall be included in the compulsory detoxification period.
- Article 29. For criminal suspects, defendants who have been detained in a detention center after undergoing criminal detention and arrest procedures, and education personnel in a detention center who need physical detoxification treatment in a compulsory detoxification center, the detention center and The opinions of the shelter education institute are reported to the public security organs at or above the county level for approval, and can be treated in the designated compulsory detoxification center. The guardianship during the treatment period will be assigned by the original supervision place, and will be escorted back to the original supervision place immediately after detoxification.
- Article 30 If a drug addict dies during the compulsory detoxification period, the compulsory detoxification center shall notify the public security organ that made the decision to organize a forensic doctor or a designated doctor to make a death appraisal, and fill out the "Notice of Compulsory Addicts Death" after inspection by the people's procuratorate at the same level. , Notify the family of the deceased, the unit or the police station where the hukou is located; corpses that are not claimed by the family members shall be approved by the public security organ that made the decision to report to the compulsory detoxification center and processed after taking pictures. The public security organ that originally made the decision shall report the death identification and other relevant information to the public security organ at the next higher level for the record.
- Article 31 If a drug addict refuses to accept the compulsory detoxification decision, applies for reconsideration or brings an administrative lawsuit to a people's court, the compulsory detoxification center shall promptly send the materials to the relevant department for processing. For those who report the drug abusers' reports, expose and accuse the staff of the compulsory detoxification centers of illegal acts and disciplines, the compulsory detoxification centers shall promptly send them to the relevant departments or higher authorities for processing.
- Chapter IV Medical Treatment and Rehabilitation
- Article 32 The compulsory detoxification center shall adopt symptomatic drug treatment measures and establish treatment files for detoxification personnel; patients with infectious diseases such as AIDS, gonorrhea, and syphilis, and those infected with the virus shall be provided with isolated detoxification treatment.
- Article 33 The compulsory detoxification center must use detoxification drugs in accordance with relevant regulations, and shall not use detoxification drugs that have been approved for clinical use or trial without approval.
- Article 34 A compulsory detoxification center shall establish a strict drug treatment drug management system. For the narcotic drugs and psychotropic drugs used for detoxification, they shall be managed by special persons, and special receipt and payment books, special prescriptions and special register registration shall be established and kept by special persons. If it is necessary to use detoxification drugs for detoxification personnel, a doctor should prescribe a prescription and supervise the detoxification personnel to take drugs on the spot.
- Article 35 The compulsory detoxification center shall implement a system of 24-hour watch and regular ward rounds for medical personnel to prevent accidents among detoxification personnel during detoxification treatment.
- Article 36 The compulsory detoxification center shall organize detoxification personnel who have undergone detoxification treatment to carry out cultural and sports activities conducive to physical rehabilitation; on the premise of ensuring safety, detoxification personnel may be organized to participate in moderate labor.
- Article 37 The compulsory detoxification institution shall check whether the detoxification personnel have expired physiologically after the compulsory detoxification period is about to expire. For those who have not yet undergone physical detoxification, the compulsory detoxification center may submit opinions, fill out the "Approval Form for Extension of the Compulsory Detoxification Period", and submit it to the original public security agency for approval to extend the compulsory detoxification period; however, the actual implementation of the compulsory detoxification period may not be calculated continuously. More than a year.
- Chapter V Life and Health
- Article 38 A compulsory detoxification center shall establish office areas, detoxification treatment areas, cultural and sports activities areas, production and labor areas, and be equipped with necessary medical equipment and fitness equipment. The detoxification treatment area shall be provided with a detoxification room, an observation room, a treatment room, a pharmacy, a test room and a duty room. The pharmacy in the detoxification treatment area shall have the conditions for storing narcotic drugs, psychotropic drugs and toxic drugs for medical use. The treatment room should be equipped with conditions for diagnosing and treating common complications of detoxification and other emergency facilities.
- Article 39 The area of each detoxification ward shall not be less than three square meters per person on average; it shall be ventilated and lighted to prevent cold, heatstroke and moisture.
- Article 40 The compulsory detoxification center shall establish a sanitary and epidemic prevention system, and facilities shall be provided for the bathing, haircutting, and quilting of detoxification personnel; the indoor and outdoor areas shall be kept clean and sanitized, and disinfected regularly;
- Article 41 The living expenses and treatment expenses of detoxification personnel during detoxification treatment shall be borne by themselves or their families. If the drug addicts are really unable to pay, the local police station shall issue a certificate, and the compulsory detoxification agency shall prepare a budget plan and report it to the local financial department. Standards for living expenses and treatment expenses for drug addicts are uniformly formulated by the public security departments and bureaus of various provinces, autonomous regions, and municipalities in accordance with local conditions, and reported to the Ministry of Public Security for the record.
- Article 42 The compulsory detoxification institution shall issue receipts for the living expenses and treatment expenses paid by drug addicts or their family members, with separate accounts and separate management, and the food accounts shall be published and released once a month. Interdiction, misappropriation and other embezzlement are strictly prohibited. The canteen of the detoxification staff should be separated from the staff canteen, and a separate stove should be set up to ensure food hygiene. It is necessary to respect the ethnic customs of ethnic minority drug addicts.
- Chapter VI Exit
- Article 43 After the compulsory detoxification period has expired, the detoxification personnel who have been physiologically detoxified upon inspection shall go through the exit procedures upon approval by the director of the compulsory detoxification center and issue a "Certificate of Lifting Compulsory Detoxification" to notify their family members or units Get it back. The detoxification personnel shall collect the property deposited at the entrance on the basis of the "Registration Form for the Deposit of Compulsory Detoxification Personnel's Property".
- Article 44 If a drug addict is approved for criminal detention, arrest, or reeducation through labor, juvenile shelter, education, or education for other illegal and criminal acts, the compulsory detoxification center shall terminate its detoxification in the compulsory detoxification center and handle the transfer of the drug in accordance with the relevant legal documents. formalities.
- Article 45 For the drug addicts who have left the drug expiration period, the compulsory drug addicts shall notify the public security police station of their permanent residence or temporary residence, and conduct regular follow-up investigations and return visits to cooperate with the drug addicts, their families, their units or residences ( Village) people's committees, police stations where permanent resident registration is located, or local temporary residence police stations implement measures to help them to consolidate the effect of detoxification.
- Article 46 When a detoxification person leaves a compulsory detoxification center, the compulsory detoxification center shall register for the premises and complete the "Registration Form for Compulsory Detoxification Personnel".
- Chapter VII Supplementary Provisions
- Article 47 The compulsory detoxification center can accept voluntary drug addicts, but it must be managed separately from the compulsory detoxification personnel and a corresponding management system must be established.
- Article 48. "Detoxification personnel" in these measures refers to compulsory detoxification personnel.
- Article 49 The "above" in these measures includes the original number.
- Article 50 Hierarchical management of compulsory detoxification centers shall be implemented, and specific measures shall be formulated separately by the Ministry of Public Security.
- Article 51 The document format of a compulsory detoxification center shall be uniformly formulated by the Ministry of Public Security.
- Article 52 The interpretation of these measures is the responsibility of the Ministry of Public Security.
- Article 53 These Measures shall be implemented as of the date of promulgation.
