Artificial gas Chapter 1 General

Article 1 These Measures are formulated in order to strengthen the management of urban gas, safeguard the legitimate rights and interests of gas supply enterprises and users, regulate the gas market, guarantee social public safety, improve environmental quality, and promote the development of the gas industry.
Article 2 These Measures apply to the planning, construction, operation, production, sales of appliances, and use and safety management of urban gas.
Article 3 The development of urban gas should follow the principles of unified planning, supporting construction, adapting to local conditions, rational use of energy, and equal emphasis on construction and management.
Article 4 The construction administrative department of the State Council is responsible for national urban gas management. The municipal construction administrative department of the local people's government at or above the county level is responsible for the management of urban gas in its own administrative area.
Article 5 The State encourages and supports the scientific and technological research of urban gas, promotes advanced technologies, and improves the scientific and technological level of urban gas.

Chapter 2 Planning and Construction of Artificial Gas

Article 6 Local people's governments at or above the county level shall organize planning, urban construction and other departments to compile local gas development plans based on the overall urban planning.
The construction, reconstruction, and expansion of urban gas projects and the layout of business outlets must be in accordance with the urban gas development plan and can only be implemented after approval by the urban construction administrative department.
Article 7 Funds for urban gas construction may be raised through various channels including government investment, fund raising, domestic and foreign loans, and bond issuance in accordance with relevant state regulations.
Article 8 The design and construction of a gas project shall be undertaken by the design and construction unit holding the corresponding qualification certificate, and shall conform to the relevant national technical standards and specifications.
It is forbidden to undertake gas engineering design and construction tasks without a certificate or beyond the scope of business specified in the qualification certificate.
Article 9 The construction of gas projects in residential quarters may be undertaken by units with corresponding qualifications responsible for the construction of the districts.
The fuel gas facilities of civil buildings shall be designed, constructed and inspected simultaneously with the main project.
The installation of the gas meter should comply with the specifications, taking into account the indoor beauty, and convenient for users.
Article 10 The project quality supervision system shall be implemented for the construction of gas projects.
Article 11 After the completion of a gas project, the competent department of urban construction administration shall organize the relevant departments for acceptance; those who have not received the acceptance or failed the acceptance shall not be put into use.
Article 12 Within the safety protection scope stipulated on the ground and underground of fuel gas facilities, it is prohibited to construct buildings, structures, stacking articles and digging and digging to jeopardize the safety of gas supply facilities.
Article 13 If it is really necessary to change the gas facilities, the construction unit shall report to the city planning administrative department and the city construction administrative department of the local people's government at or above the county level for approval. The expenses incurred in modifying the gas facilities shall be borne by the construction unit.
Article 14 In the construction of new urban areas and the reconstruction of old areas, fuel gas facilities shall be constructed in accordance with urban gas development plans.
High-rise houses shall be equipped with supporting facilities for gas pipelines.
Article 15 No unit or individual may obstruct the construction and installation of an approved public pipeline gas engineering project without justified reasons.

Chapter 3 City Gas Management

Article 16 Where a city's fuel gas is supplied by a pipeline, regional unified operations shall be implemented. Bottled gas can be operated in multiples.
Article 17 A gas supply enterprise must pass the qualification examination and be registered with the administrative department for industry and commerce before it can engage in business activities. The qualification examination measures shall be implemented in accordance with the Regulations on the Qualification Management of Urban Gas and Heating Enterprises.
Article 18 Fuel gas supply enterprises shall abide by the following regulations:
(1) The quality and pressure of fuel gas shall meet the standards set by the state. Ensure safe and stable gas supply, and do not stop gas supply for no reason;
(2) It is forbidden to provide operating gas sources to units without the "City Gas Enterprise Qualification Certificate";
(3) Users shall not be forced to purchase designated gas appliances at designated locations;
(4) It is forbidden to use steel cylinders that have passed the inspection period and failed the inspection;
(5) It is forbidden to use tank cars to directly fill the cylinder with liquefied petroleum gas;
(6) Other provisions to be observed.
Article 19 The staff and workers of gas supply enterprises and gas appliance installation and maintenance units shall implement a system of employment with certificates. The specific measures shall be formulated by the construction administrative department of the State Council in conjunction with relevant departments.
Article 20 If a gas supply company and a distribution site need to be changed, closed, closed, separated or merged, it must apply to the urban construction administrative department 30 days in advance. Only after approval can be implemented.
Article 21 The determination and adjustment of gas prices shall be proposed by the competent administrative department of urban construction, and shall be implemented after review and approval by the price department.

Artificial Gas Chapter 4 Urban Gas Appliances

Article 22 The production of gas appliances implements a product production license or a safety and quality certification system. Gas appliances can only be produced after obtaining the national gas appliance product production license or safety quality certification.
Article 23 Gas appliances must be tested for gas source suitability by a testing agency designated by the city construction administrative department in the place of sale, meet the gas use requirements in the place of sale, and be sold only after a permit is issued.
The products that have obtained the permits will be listed in the local "Gas Appliance Sales Catalog" by the city construction administrative department and announced to users.
Article 24 Units engaged in the installation and maintenance of gas appliances must be qualified by the city construction administrative department before they can engage in the installation and maintenance of gas appliances.
Article 25 Enterprises producing and operating gas appliances must have product after-sales maintenance guarantee measures at the place of sale.

Artificial Gas Chapter 5 Urban Gas Use

Article 26 A gas supply enterprise shall establish a gas user file, sign a gas supply contract with the user, and clarify the rights and obligations of both parties.
Article 27 A gas user may not connect to a pipeline to use gas or change the nature, address, or name of a gas without the approval of a gas supplier.
Article 28 Fuel gas measurement shall adopt a fuel gas measurement device that complies with national measurement standards, and shall be regularly checked in accordance with regulations.
Article 29 Gas users shall abide by the following regulations:
(1) Proper use of gas according to the use plan;
(2) It is prohibited to misappropriate or transfer gas;
(3) It is forbidden to heat liquefied petroleum gas cylinders;
(4) It is forbidden to pour gas into bottles and dump residual liquid. Residual liquid is dumped by the gas supply company;
(5) It is forbidden to change the inspection mark of the cylinder without authorization;
(6) It is forbidden to disassemble, install and modify gas measuring instruments and gas facilities by themselves;
(7) Water heaters, air conditioners and other equipment using pipeline gas as fuel must be approved by the gas supplier and installed by the unit holding the corresponding qualification certificate.
(8) Other acts required by laws and regulations.
Article 30 Gas users shall pay gas fees on time. If the payment is not overdue, the gas supply enterprise may charge a late fee of 3 -1% of the gas charge payable to the user who fails to pay the gas fee from the overdue date.
Article 31 Gas users have the right to inquire the gas supply enterprises about the fees and services for gas operations, and they can complain to their administrative departments if they do not meet the service or charging standards.

Artificial Gas Chapter 6 Urban Gas Safety

Article 32 Fuel gas supply enterprises must establish systems such as safety inspection, repair and maintenance, and emergency repair, promptly report, eliminate, and handle faults and accidents of fuel gas facilities to ensure normal gas supply.
Article 33 A gas supply company must announce the repair phone to the society, set up a full-time repair team, and equip it with protective equipment, vehicle equipment, and communication equipment.
A gas supply enterprise shall implement a 24-hour watch system on a daily basis. When a gas facility accident is discovered or a gas facility accident report is received, it shall immediately organize emergency repairs and rescue.
Article 34 A gas supply company must formulate rules for safe use, publicize common sense of safe use, and instruct users on the safe use of gas.
Article 35 Fuel gas supply enterprises shall, in accordance with relevant regulations, set up uniform and obvious safety warning signs at the locations of important fuel gas facilities, and allocate full-time personnel to carry out roving inspections.
It is strictly forbidden to move, cover, alter, dismantle or destroy the safety warning signs of gas facilities without authorization.
Article 36 Any unit or individual who discovers a gas leak or poisoning, fire or explosion caused by gas shall be obliged to notify the gas supply enterprise and the fire control department.
After a gas accident occurs, the gas supply enterprise shall immediately report it to the city construction administrative department, and a major gas accident shall be reported to the construction administrative department of the State Council in a timely manner.
Article 37 Gas accidents shall be handled in accordance with the relevant laws and regulations.
In the event of a major gas accident, under the unified leadership of the people's government in the place where the accident occurred, the urban construction administrative department in conjunction with the relevant departments of public security, fire protection, labor and other relevant departments shall form an accident investigation team to investigate and handle the accident.
Article 38 Each locality may implement a gas accident insurance system in accordance with the actual conditions of the locality.
Article 39 Except for emergency situations such as fire fighting, no one shall open or close public valves on gas pipelines without the consent of the gas supply enterprise.

Artificial Gas Chapter VII Legal Liability

Article 40 If one of the following acts is violated in accordance with these Measures, the urban construction administrative department shall order the design and construction to be stopped, make corrections within a time limit, and may be fined from 10,000 yuan to 30,000 yuan; the design and construction qualifications have been obtained Certificate, if the circumstances are serious, the original certificate-issuing authority is requested to revoke the design and construction qualification certificate:
(1) failing to obtain design and construction qualifications, or failing to undertake design and construction tasks for urban gas projects in accordance with qualification levels;
(2) Failure to design and construct in accordance with relevant technical standards and specifications.
Article 41 If the provisions of Article 6, Paragraph 2, Article 11, Article 13, Article 17, Article 20, and Article 24 of these Measures are violated, the administrative department of urban construction shall order it to stop Illegal acts may be punished by a fine ranging from 10,000 yuan to 10,000 yuan.

Article 45 If a staff member of an administrative department of urban construction neglects his or her duties, abuses his power, or engages in malpractices for personal gain, he shall be given administrative sanctions by his unit or the competent department at a higher level, which constitutes a crime and shall be investigated for criminal responsibility according to law.

Chapter 8 Supplementary Provisions for Artificial Gas

Article 46 The meanings of the following terms in these Measures are:
(1) Urban gas refers to the general term for gas fuels such as artificial gas, natural gas, and liquefied petroleum gas.
(2) A fuel gas supply enterprise refers to a fuel gas production, storage, transportation, distribution, and supply enterprise;
(3) Fuel gas facilities refer to various equipment and auxiliary facilities for the production, storage, transportation, distribution, and supply of fuel gas.
(4) Gas appliances include gas cookers, public gas appliances, gas baking appliances, gas hot water, boiling water appliances, gas heating appliances, gas transportation vehicles, gas heaters, gas measuring appliances, cylinders, pressure regulators, etc. .
Article 47 The administrative departments for construction of provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation rules in accordance with these Measures.
Article 48 These Measures shall become effective on January 1, 1998.
