This book cuts through the difficulties faced by the interpretation of criminal law, leading to the issue of criminal law argumentation. The first chapter explores the basic issues of criminal law argumentation methods in order to provide theoretical analysis tools for subsequent chapters. The second to fourth chapters are the "view-switching" argumentation method and the criminal law system analysis and argumentation method, the criminal law's constitutional argumentation method, the criminal law internationalization argumentation method, the procedural argumentation method, and the civil-penalty-related argumentation method. The element-related argumentation method, the element-related argumentation method of crime, and the element-related argumentation method of punishment are combed, summarized, and analyzed. The fifth chapter discusses the comprehensive application of the criminal law argumentation method.
Qin Zheng, born in 1956, was born in Shimen City, Hunan Province. Doctoral supervisor, professor. Postdoctoral fellow of Xi'an Jiaotong University, PhD of Northwestern Polytechnical University. He is currently the director of the Institute of Electronic Commerce of Xi'an Jiaotong University, the deputy dean of the Shenzhen Research Institute of Xi'an Jiaotong University, and the expert of the Coordination Group of Electronic Commerce Disciplines of China's colleges and universities. In the past 5 years, he has won one first prize and two second prizes in science and technology progress from the Ministry of Education, and one third prize in science and technology progress in Shaanxi Province. Main research directions: computer system integration and e-commerce, complex information processing, e-commerce system structure and process control. Supervising 1 postdoctoral fellow, more than 30 doctoral students, 15 master students. He has published more than 50 papers and published more than 10 academic monographs in important academic journals at home and abroad.
