What Are Relocation Expenses?

Relocation subsidy means that the demolisher should pay the relocation subsidy to the demolished person or the house tenant. When relocating a residential house, the relocation subsidy is calculated based on the original housing construction area and the prescribed subsidy standard; if the demolisher is responsible for the relocation, the demolisher will no longer pay the relocation subsidy. For the demolition of non-residential houses, the relocation subsidy includes: (1) equipment relocation and installation costs; (2) equipment that cannot be used again can be newly settled according to the replacement price.

The demolisher shall pay the relocation subsidy to the demolished person or the house tenant.
Within the transition period, if the demolished person or the house tenant arranges their own accommodation, the demolisher shall pay the temporary resettlement subsidy; if the demolished person or the house renter uses the revolving house provided by the demolisher, the demolisher does not pay the temporary resettlement subsidy .
The standards for relocation subsidies and temporary resettlement subsidies shall be prescribed by the people's governments of provinces, autonomous regions and municipalities.
The method of compensation for demolition can be monetary compensation or house property rights swap.
Except for the provisions of Article 25, Paragraph 2 and Article 27, Paragraph 2 of the Regulations on the Administration of Urban House Demolition, the demolished people can choose the method of compensation for demolition.

Where house demolition is carried out on foreign-owned land in urban planning areas, and compensation and resettlement are required for the demolished, refer to the urban house demolition management regulations.
2. Effective Date of Regulations on Management of Urban House Demolition
The regulations for the management of urban house demolition will come into effect on November 1, 2001. The "Regulations on the Management of Urban House Demolition" promulgated by the State Council on March 22, 1991 was repealed simultaneously. [1]
Demolition compensation fees generally include 8 parts:
1. Real estate appraisal price;
2. Compensation fees for decoration;
3. Relocation subsidy (including production equipment removal and disassembly costs);
4. Temporary resettlement subsidy;
5. Compensation fees for ancillary facilities;
6. Tree flower compensation fee;
7. Compensation fees for suspension of production and business caused by demolition of non-residential houses;
