What Is Water Transportation?

- In order to strengthen water transportation management, maintain transportation order, and improve transportation efficiency, the State Council issued the "People's Republic of China Water Transport Management Regulations. The "Regulations" stipulate that the establishment of water transport enterprises, water transport service enterprises, and units and individuals engaged in commercial transportation shall be reviewed and approved by the competent transportation department in accordance with the relevant state regulations and the comprehensive assessment of social transportation capacity.
- The establishment of a water transport enterprise must meet the following requirements:
- (1) Transport ships suitable for the business scope;
- (2) There are relatively stable sources of customers and goods;
- (3) For passenger transportation, the port (station) of the passenger ship along the line shall be implemented and corresponding service facilities shall be provided;
- (4) Organization and person in charge of business management;
- (5) Have its own working capital suitable for transportation business.
- To establish a waterway transportation service enterprise, it is necessary to meet the above 4 conditions and have its own working capital suitable for the waterway transportation service business. Units and individuals other than waterway transportation enterprises engaged in commercial transportation must meet the requirements of items 1, 2, 3, and 5 above, and have a responsible person in charge.
- The competent transportation department shall issue a transportation license to the approved waterway transportation enterprises and other units and individuals engaged in business transportation; to the approved establishment of a waterway transportation service enterprise, a transportation service license shall be issued. Units and individuals who have obtained transportation permits and transportation service permits shall apply for business registration with the local industrial and commercial administrative organs, and may start business only after obtaining approval to obtain a business license.
- Carriers and shippers for commercial waterway cargo transportation must sign a transportation contract in accordance with the Contract Law and the Detailed Rules for the Implementation of Waterway Freight Transportation Contracts.
- If one of the following acts is violated, the competent traffic department may be punished by warning, fine, and suspension of business:
- (L) Without approval, setting up waterway transportation enterprises and waterway transportation materials enterprises without authorization;
- (2) Without approval, units and individuals other than water transportation enterprises engage in business transportation without authorization;
- (3) Raising freight rates or charging service fees in excess of prescribed charging standards;
- (4) Business transportation is not carried out with the prescribed transport bills;
- (5) Payment of regulatory fees and transportation management fees in accordance with regulations;
- (6) Monopolizing the supply of goods and forcing services on behalf of them;
- (7) Those who disturb the order of water transportation and disobey management.
- Anyone who violates the above provisions and should be punished by public security management shall be dealt with by the public security organs; if a crime is constituted, the judicial organ shall be held responsible for the criminal responsibility of those responsible.
