- Article 2 The State Food and Drug Administration implements an expert consultation system to seek the opinions and suggestions of catering safety experts when formulating policies, systems and plans for catering service food safety supervision and conducting major project review and demonstration. - Article 3: Catering safety experts shall have the following basic conditions:
- (1) to support the party's line, principles, and policies, and to abide by national laws and regulations;
- (2) Have a senior professional and technical title of the corresponding major or an equivalent professional level, be proficient in related business, and enjoy a high reputation in their professional field;
- (3) Familiar with relevant food safety laws, regulations and standards, understand the development direction of food safety science and technology, and have rich practical experience;
- (4) Having good professional ethics, upholding principles, being objective, fair, and responsible;
- (5) Other conditions stipulated by the State Food and Drug Administration.
- Article 4 Candidates for food safety experts shall provide the following materials and be responsible for the authenticity of the materials provided:
- (1) Education background and job resume;
- (2) Educational background, degree and professional qualification certificate (copy);
- (3) Brief description of research or work achievements, including academic papers, scientific research results, etc .;
- (4) a valid certificate (photocopy) to prove his identity;
- (5) Recommendations issued by the unit or professional society (association).
- Article 5 Candidates for catering safety experts are generated by individual application or recommendation by the unit or professional society (association).
- The State Food and Drug Administration selects and hires expert candidates. The employment period is 3 years. [1]
- Article 6 The main duties of catering safety experts:
- (1) Entrusted by the State Food and Drug Administration to carry out research on policies, regulations and systems related to food service food safety supervision;
- (2) conducting consultation on food safety supervision of catering services;
- (3) Analyze and research the major issues of food service food safety, and put forward handling opinions and suggestions;
- (4) Participate in emergency response to major food safety accidents in catering services, and put forward suggestions and suggestions for handling them;
- (5) Carrying out technical review of fast food testing methods for food service;
- (6) Participate in food safety analysis of food service;
- (7) Undertake other tasks assigned by the State Food and Drug Administration.
- Article 7 Food and beverage safety experts have the following rights when participating in related activities:
- (1) consulting relevant food safety supervision data and understanding of relevant supervision work;
- (2) expressing their opinions fully, impartially and objectively, without any interference from any unit or individual;
- (3) putting forward opinions and suggestions on the management of catering safety experts;
- (4) Different opinions can be recorded in the conclusion of the expert meeting;
- (5) Get corresponding remuneration in accordance with relevant regulations;
- (6) Other rights provided by laws and regulations. [1]
- Article 8 When participating in related activities, catering safety experts bear the following obligations:
- (1) Actively participate in relevant supervision activities, provide objective, fair, specific and clear recommendations and opinions, and be responsible for the opinions signed;
- (2) strictly abide by the confidentiality regulations, and shall not publish, transcribe and circulate related confidential matters without the consent of the State Food and Drug Administration;
- (3) discovering violations of laws and regulations regarding food safety in catering services, and reporting the situation to the State Food and Drug Administration in a timely manner;
- (4) voluntarily withdraw from activities related to their own interests;
- (5) Actively participating in public welfare activities related to food service and food safety;
- (6) No related commercial activities shall be conducted in the name of experts of the State Food and Drug Administration;
- (7) Other obligations provided by laws and regulations.
- Article 9 The State Food and Drug Administration has established an expert committee on catering safety, which is composed of all experts.
- The expert committee has one chairman and several vice-chairmen.
- The expert committee may establish an expert group according to the needs of the work.
- Article 10 The secretariat of the expert committee is responsible for the daily management and service of the catering safety expert committee.
- The secretariat of the expert committee has a secretary general.
- The secretariat of the Expert Committee is located in the China Food and Drug Inspection Institute.
- Article 11 The main duties of the Secretariat of the Expert Committee:
- (1) Responsible for the application and acceptance of candidates for catering safety experts, review the qualifications of candidates, put forward review opinions, and submit them to the State Food and Drug Administration for approval;
- (2) Formulate annual work plans for catering safety experts, arrange experts to carry out related work or participate in related activities, and provide related services;
- (3) providing relevant materials and information to catering safety experts;
- (4) Establishing a basic information database of catering safety experts, and dynamically grasping the work and progress of catering safety experts;
- (5) Other matters related to daily management of catering safety experts.
- Article 12 The State Food and Drug Administration conducts dynamic assessment and management of catering safety experts.
- Article 13 The State Food and Drug Administration praises catering safety experts who have demonstrated outstanding performance in related work.
- Article 14 If a food safety expert violates these Measures, the State Food and Drug Administration will be dismissed. Any violation of law shall be handled in accordance with relevant laws and regulations.
- For dismissed experts, the State Food and Drug Administration is no longer employed.
- Article 15 The interpretation of these measures is the responsibility of the State Food and Drug Administration.
- Article 16 These Measures shall be implemented as of the date of promulgation. [1]
