What is a commercial sublease?
The commercial sublease is an agreement on the lessee to the tenant, which is created and signed to manage the occupancy of commercial assets. Leasing of commercial assets usually include two parties: a person or company that owns a commercial property, and a person or company that agrees to rent these assets. However, the commercial sublease adds another party to this arrangement. The commercial sublease is essentially a contract that allows a person or company to rent from the original tenant of commercial lease. The original tenant will not cancel or otherwise give up the lease, which he signed with the owner of the property. Instead, he has two contracts. It maintains the original rental with the owner and has a separate contract with a commercial sublelettor.
In some cases, commercial subleasis are used when the company owner needs to release his rented assets before the rental expires. For example, the company owner can rent the facade and sign a two -year rental. After a few months they may decidet, that he wants to close his business or move it to a new place. The attempt to terminate his lease may be problematic, so he can instead decide to rent the property to the new tenant. When this kind of arrangement goes smoothly, the company owner finds a way from paying rent to real estate that he does not want to use without violating his rent.
Sometimes the entrepreneur plans to use the commercial space he has rented, but does not require everything. This is another situation where a commercial sublease can work well. For example, if a commercial tenant flying office space, but find that he needs only about half the space he rented, the remaining space can offer a sublelettor. This allows him to stay rented space without having to pay rent.
When the original tenant plans to offer a potential tenant a commercial sublease, it is important that it carefully checks the conditions of the original lease first. Some commercial leases may disable sublesing or require the original tenant to first obtain the permission of the landlord. If the conditions of the original lease were banned, the commercial sublease agreement would be considered invalid and could result in legal steps.
