- Chapter I General Provisions
- Article 1 These measures are formulated in accordance with the relevant provisions of the "Regulations on the Administration of the Price of the People's Republic of China" in order to strengthen the management of price evaluation, regulate the behavior of price evaluation, protect the national interests, protect the legitimate rights and interests of the parties involved in the evaluation, and promote the healthy development of price evaluation.
- Article 2 Price evaluation and management of price evaluation shall comply with these Measures.
- The term "price evaluation" as mentioned in these Measures refers to the appraisal and evaluation of the prices of goods and services by the price evaluation agency upon entrustment by the evaluation parties.
- The evaluation of state-owned assets shall be carried out in accordance with the relevant provisions of the State Council; the value of items involved in the case, that is, the administrative law enforcement agencies and judicial organs in handling administrative, criminal, civil and economic cases in the seizure, confiscation, recovery of items and disputed property and other items, shall be evaluated in accordance with the Supreme People s Court The relevant provisions of the Supreme People's Procuratorate, the Ministry of Public Security and the State Planning Commission shall be implemented.
- Article 3 The price evaluation shall follow the principles of objectivity and fairness, and shall be conducted in accordance with prescribed standards, procedures and methods.
- Price appraisal agencies and price appraisers shall abide by national laws and regulations, implement state regulations on price appraisal, practice strictly, serve honestly, and abide by credit.
- Article 4 The price management department of the State Council is responsible for the management and supervision of national price evaluation.
- The price management department of the local people's government at or above the county level shall be responsible for the management and supervision of price evaluation within its administrative area in accordance with the prescribed management authority.
- Chapter II Price Evaluation Agency
- Article 5 Institutions engaged in price evaluation must hold qualification certificates for price evaluation institutions issued by the State Council or the price management departments of the people's governments of provinces, autonomous regions and municipalities.
- The institution conducting land price assessment shall have the qualification for land valuation and shall be confirmed by the land management department and price management department; the institution conducting the real estate price assessment shall be eligible for real estate valuation and shall be confirmed by the construction administrative department and price management department.
- Article 6 The price evaluation institution shall have basic qualifications such as legal person qualifications, price evaluation professionals, corresponding articles of association and management systems.
- Article 7 The qualification of price evaluation institutions shall be implemented in a hierarchical system. According to the qualifications of the assessment agency, it is divided into Grade A, Grade B, and Grade C.
- Article 8 The qualification of price evaluation institutions shall be subject to a registration system, which shall be valid for three years. When the validity period expires, the price evaluation agency shall re-apply for practicing qualifications in accordance with the regulations.
- Article 9 When the appraisal party entrusts a price appraisal agency to conduct a price appraisal, it shall truthfully provide relevant information and information. The price evaluation agency shall keep the relevant information and information provided by the parties confidential.
- Article 10 Price evaluation is carried out with paid services. Service charges shall be reasonable, open and consistent in quality and price.
- Chapter III Price Evaluation Staff
- Article 11 Price appraisers must go through professional training and examinations and obtain a practising certificate from the price appraisers.
- Article 12 A registration system shall be implemented for the qualifications of price appraisers. Only those who have obtained the qualification certificate of price appraisers and have been registered can independently engage in price appraisal business.
- Article 13 When undertaking valuation operations, each valuation item shall not be less than two price appraisers. For large-value and complicated valuation projects, a valuation team of three or more persons should be formed for evaluation.
- Article 14 If the price appraisers have an interest or other relationship with the entrusted appraisal project and the parties to the entrusted appraisal project, which may affect the fair appraisal, they shall avoid it.
- Chapter IV Price Evaluation Procedure
- Article 15 The price evaluation shall be carried out in accordance with the following procedures:
- (1) commissioned price evaluation;
- (2) Accepting price assessments;
- (3) site survey and evaluation;
- (4) identification and estimation;
- (5) Issue a valuation report.
- Article 16 When an evaluation party entrusts a price evaluation, it shall submit an evaluation power of attorney to the evaluation agency. The valuation power of attorney shall specify the following:
- (1) the name and address of the client and the name and title of the legal representative;
- (2) the name, type, specification, quantity, source, and time (and place) of purchase (acquisition) of the subject matter for evaluation;
- (3) the reasons and requirements for commissioning the evaluation;
- (4) Other contents that the client believes need to be explained.
- The power of attorney for valuation shall be accompanied by relevant materials such as the property rights and technical standards of the valuation target.
- Article 17 After receiving the valuation power of attorney, the price evaluation agency shall review the matters specified in the valuation power of attorney and the relevant information provided by the parties. For those who meet the conditions for accepting the price evaluation, the two parties to the evaluation shall sign an evaluation business contract in accordance with the requirements of the relevant state contract and agree on the valuation related matters.
- Article 18 Price appraisers shall formulate a valuation operation plan when undertaking valuation business; valuation agencies shall establish an internal review and review system for valuation results.
- Price appraisers shall conduct on-site assessment of the evaluation target, investigate the actual condition of the evaluation target, and verify the relevant data and information. For real estate projects, site surveys and surveys and surrounding environment investigations should also be conducted. The on-site survey and evaluation shall have detailed records.
- After the on-site survey and evaluation, the price appraiser shall comprehensively analyze and evaluate the various factors related to the price of the subject matter of the evaluation, and make an estimation in accordance with the selected evaluation method to make an evaluation result.
- Article 19 The valuation results shall be delivered to the client in the form of a written report. The report of the valuation results shall include the following:
- (1) the name, type, specification and quantity of the evaluation target, the purpose of the evaluation, and the date of the evaluation;
- (2) Existing location, actual condition and survey description of the evaluation target;
- (3) analysis of valuation factors, valuation survey data, valuation methods of use, and valuation results;
- (4) Other issues that need to be explained.
- The report of the valuation result shall be signed by a price evaluation contractor who is qualified to practise registration, and shall be effective after being stamped with the official seal of the unit.
- Article 20 If the appraisal parties have objections to the appraisal results, they may apply to the original appraisal agency for review within 15 days from the date of receipt of the appraisal report. If there are still objections to the review results, unless otherwise provided, they may entrust another valuation agency to re-evaluate.
- Chapter V Legal Liability
- Article 21 In the event that the price evaluation agency and price evaluation personnel violate the provisions of these Measures by falsifying or neglecting their duties and causing the evaluation results to be false, the price evaluation agency's qualification management department may, in accordance with relevant state regulations, give the following penalties according to the severity of the situation:
- (1) warning;
- (2) fines;
- For the persons in charge and directly responsible persons of the above-mentioned punished units, the management department that has recognized the qualification of the institution may ask the relevant departments to give them administrative sanctions.
- Article 22 If the unit or individual being punished refuses to accept the decision on punishment, they may apply for reconsideration or file a lawsuit in accordance with the relevant provisions of the Administrative Reconsideration Regulations or the Administrative Procedure Law of the People's Republic of China.
- Article 23 If a price appraiser or a price appraisal manager neglects his or her duties or uses his authority to seek private gain in his work and constitute a crime, the judicial organ shall be investigated for criminal responsibility in accordance with law.
- Chapter VI Supplementary Provisions
- Article 24 The price management departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation rules in accordance with these Measures and report them to the State Planning Commission for the record.
- Article 25 The interpretation of these measures lies with the State Planning Commission.
- Article 26 These Measures shall be implemented as of January 1, 1997.
