This is of great significance for deepening the reform of the cadre personnel system, improving the civil service system, and promoting the construction of socialist democracy and politics. [1]
According to Article 82 of the Civil Servants Law, there are four types of civil service resignations depending on the reasons for resigning them: [2]
The establishment of a resignation system for resigning leadership positions is a major reform of China's traditional cadre personnel system, which fundamentally solves the shortcoming of "cadre positions can only go up and down." However, the implementation of this system will involve the interests of some leading cadres. To this end, it is necessary to create a good social environment for the implementation of the system of leading cadres resigning from their leadership positions. [2]
Civil servants who have resigned from their leadership positions within three years of their employment shall not be employed by enterprises or other for-profit organizations directly related to the original job and business, and shall not engage in profit-making activities directly related to the original job or business. If a party and government leading cadre resigns and an economic responsibility audit is required in accordance with relevant regulations, the party committee (party group) and its organization (personnel) department shall entrust an auditing agency to conduct an economic responsibility audit. [3]
Resignation of party and government leading cadres shall, within 15 days from the date of approval by the appointment and removal organ, complete relevant formalities such as transfer of official duties.
Those who refuse to go through the formalities of handover shall be punished in accordance with relevant regulations.
Party and government leading cadres shall not resign without authorization during the period of resignation approval or during the organization's decision to suspend their resignation. Those who resign without authorization shall be punished in accordance with relevant regulations.
If a cadre who blame resignation or is ordered to resign simultaneously proposes to resign from public office, he shall meet the conditions listed in Article 12 of these regulations. Among them, cadres who order to resign at the same time propose to resign from public office, must follow the procedure of voluntary resignation.
If a cadre who blame resigns or is ordered to resign constitutes a disciplinary violation, the party shall be given disciplinary and disciplinary sanctions in accordance with relevant regulations; if he violates the law, legal responsibility shall be investigated.
Cadres who blame resignation, order resignation, and voluntarily resign from leadership positions shall be appropriately arranged according to the reasons for resignation, personal conditions, and job needs.
