What Does a Conciliator Do?

Mediator refers to the person who is responsible for mediating civil disputes at the People's Mediation Committee, including members of the Mediation Committee and mediators of the mediation team.

1. The task of the People's Mediation Committee is to mediate civil disputes, to publicize laws and policies through mediation, and to report the situation of civil disputes and mediation to relevant departments.
2. The People's Mediation Committee mediates disputes in accordance with the law and social morality, conducts mediation on the basis of voluntary equality between the two parties, and respects the parties' litigation rights.
3. Mediation disputes shall be registered and recorded. If the disputes resolved through mediation have the content of civil rights and obligations or the parties require, a written mediation agreement shall be made, and a return visit shall be made in a timely manner to record the implementation.
4. The mediation disputes of the People's Mediation Committee are generally settled within one month. People's mediation should use the format of the people's mediation document formulated by the Ministry of Justice. People's Mediation Committee does not charge for mediation of civil disputes.
5. The People's Mediation Committee shall do a good job of filing and management of the organization list of the mediation committee, the list of dispute informants, the registration form for mediation disputes, the registration list for major conflicts and instability factors, mediation files, and people's mediation propaganda materials.
6. The People's Mediation Committee shall conduct regular reconciliation of civil disputes in the area under its jurisdiction, and mediate the disputes identified by the arbitration implementation personnel, which shall be reported in a timely manner that does not fall within the scope of the people's mediation or fails.
7. People's mediators must abide by work disciplines, must not engage in malpractices for personal gain, be courteous, and must not suppress, retaliate, insult or punish the parties, or disclose the parties' privacy.
8. The people's mediation work is guided by the judicial administrative organs and the people's courts, and accepts the supervision of the people.
